Estate of CYNTHIA HOWARD Minor

 

At this day comes J. O. STRAUGHAM Guardian of the Estate of CYNTHIA HOWARD and made report of the Condition of his wards Estate which shows cash on hands $244 30/100, balance on notes of A. FORMAN & others $229 32/100 (?) with interest thereon, 140 acres of land, one Negro Girl ordered by the court that said report be approved.

At this day comes ELISHA CHAMBERS admr. of the Estate of W. C. CHAMBERS decd. with his account current with said Estate for final settlement and it appearing to the Court that notice had been given according to Law of said settlement, the court proceeded to examine said account, and it appearing to the Court that the same was fairly made, It is therefore ordered adjudged and decreed by the Court that the same in all things be confirmed.

 

Estate of W. C. CHAMBERS decd.

 

It appearing to the Court that upon final settlement of the Estate of W. C. CHAMBERS deceased, that there is in the hands of the administrator of said Estate the following effects: to wit Cash $1016.02 a quarter master receipt uncollected for 91.40 one other for 250.50 a receipt from Capt. J. L. READ for 15$ two tracts of Land one tract contains 160 acres Prairie a part of the headright Surveys of JOHN LARAMORE and THOMAS BRUCE the other tract contains 60 acres and is a part of the headright survey of THOS. LINDSEY, ordered by the Court that said administrator pay over to BURRELLA CHAMBERS wife of the deceased one half of the cash on hand, and the other half to MARY E. CHAMBERS Infant child of Said deceased, or her legal representative, and it is ordered by the Court that ANDY DOUGLAS, A. WILSON and PLEASANT WILSON be appointed commissioners to partition and divide the following lands to wit 160 acres Prairie and 60 acres timbered land, between BURRELLA CHAMBERS and her infant Child MARY E. CHAMBERS, seting (sic-setting) apart 1/3 to said MARY E., and make report to the July Term of this Court.

Upon the final settlement of the administrator of the Estate of R. M. MUGG deceased, it appears to the Court that there is in the hands of said administrator 491 acres of Land and one Lot in the town of Weston, and $387.66 subject to partition and distribution among the heirs of said deceased and it appearing to the Court that the following named persons are the heirs of said Estate to wit, CATHARINE MUGG, wife of said deceased, MARGARET A., SARAH A., ELIZABETH, CATHARINE, ELLEN, WILLIAM, JAMES, ROBERT H., PERRY MUGG. Ordered by the Court that JAMES SPENCER, BENJ. WHITE and A. J. McANEAR be appointed commissioners to make partition and distribution of the forgoing named Estate among the above named heirs, seting (sic-setting) apart to the sd. At this day come on to be heard the application of M. ELLEN HARBERGER & her husband J. H. HARBERGER for partition and distribution of the property belonging to the estate of SAML. BOGART and his surviving wife RACHEL BOGART, and it appearing to the Court that JOHN NELSON administrator of said estate has in his hands sufficient claims to pay off and discharge all of the liabilities & indebtedness of the same, It is ordered that the reminder of the property both real and personal belonging to said estate, to wit 150 acres of land late Homestead of said deceased, 369 acres of land in Maddison (sic) County Texas 133 ½ acres of land in Denton County Texas, one negro Woman and two children and one Negro man, one 4 year old steer and a lot of Books, be partitioned and distributed as follows to wit to the said RACHEL BOGART one half of all the before mentioned property and the remaining half to be divided equally between M. ELLEN HARBERGER, JANE E. CLEMENT and ELIZA BRYAN Children and heirs of said SAML. BOGART deceased, and It further appearing to the Court that RACHEL BOGART has received two hundred and fifty dollars out of said estate It is ordered that the same be deducted from her share of said Estate, and It appearing to the Court that during the life time of the decedent he made advancement to JANE E. CLEMENTS and M. ELLEN HARBERGER as follows to wit to JANE E. CLEMENTS a certain tract or parcel of land by deed recorded in Book J Pages 517 & 518 and to the said M. ELLEN HARBERGER a certain tract of land by deed recorded in Book O Pages 393 & 394. Now therefore it is ordered and decreed that the said property so advanced shall be brought into hotch potoch, and by the commissioners be valued and the same taken into account in the partition & distribution of the reminder of said property, and in case either of the heirs who have received such advancement shall chance to take such advancement for her share of said estate or refuse to have the same place in hotch patch & revalued then the Commissioners shall proceed to Distribute property between the said RACHEL BOGART & the other heirs as above described that is one half to said RACHEL BOGART deducting 250$ heretofore Received by her, and the remaining half equally between such of the heirs aforesaid as shall bring their advancements into hotchpotch for valuation. It is further ordered by the Court that W. B BENGE, JNO. SHIELDS, G. R. GATES, DAVID WYLIE, & J. S. HGOUE be appointed Commissioners to partition said Estate which is in the County of Collin, according to this order, taking into consideration quality and quantity and make report of their action to this court at its February Term 1864.

On this day comes JAMES HELMS by petition, one of the heirs of THOMPSON and ABIGAIL HELMS Decd. and prays for partition and distribution of the said Estate. Now on this day come S. COFFEY, Executor of the last will and testament of CATHARINE DIXON Deceased by petition and prays for an order of sale for one hundred & seventeen Bushels of wheat by measure and one third of the corn raised on 45 acres quantity not known by the court that S. COFFEY proceed to sell at public outcry to the highest bidder on a Twelve month credit the rent (?) grain taking note and approve security of the purchaser.
