Estate of J. M. & ELIZA BOUNDS Decd.

 

Now at this day comes CHARLES R. BREEDLOVE Administrator on the estate of J. M. & ELIZA BOUNDS Decd. by petition and prays the court to be relieved from the Administration of said Estate and it being proven to the Court that the Notices required by law has been given it is ordered by the Court that said CHARLES R. BREEDLOVE be and is hereby relieved of the administration of said Estate.

 

Estate of DAVID WETSEL Deceased

 

Now at this day comes CHARLES R. BREEDLOVE Administrator of the Estate of DAVID WETSEL Decd. by petition and prays the Court to be relieved of the Administration of said Estate and the Court being satisfied that the Notices required by law had been given it is ordered by the Court that the said CHARLES R. BREEDLOVE be and is hereby relieved of the Administration of said Estate and it further ordered by the Court on the petition of ALEX BERRY from (?) filed that said BERRY be appointed Administrator pro tem on the Estate of DAVID WETSEL Decd. with power to collect and pay over to S. M. BANDY widow of said Deceased a sum not exceeding Fifty Dollars of the assets of said Estate and to report his actions herein to the next term of the court.

Now at this day comes HUGH WHISENANT by petition and prays the court for the appointment of Administrator on the Estate of R. C. WHISENANT Decd. and it appearing to the Court that proper Notice had been given, Ordered by the Court that HUGH WHISENANT be and is hereby appointed Administrator of said Estate and that Letters be issued to him when he executes bond for the faithful performance &c.

 

Estate of A. B. PERRIN

 

At this day come the appraisers (?) appointed to appraise the Estate of A. B. PERRIN and made their report, ordered by the court that the report be received and that the same be recorded by the clerk.

 

Estate of A. B. PERRIN

 

Now comes ELLEN THOMAS Administratrix of the Estate of A. B. PERRIN Decd. and prays the court for an order of sale of sufficient property of the Same Estate to pay off the indebtedness of the Estate, Ordered by the Court that ELLEN THOMAS Admrx. Proceed to Sell Sufficient property belonging to said Estate at public outcry to the highest bidder for cash in hand for all sums of Five dollars &c under and Sums over that amount on Three months credit taking notes and good security.

 

Estate of RICHARD GRAVES

 

Now at this day comes MARY JANE GRAVES by petition and prays the court for the Probate of the last will and Testament of RICHARD GRAVES Decd. and prays to be appointed Executrix of the same, ordered by the court that the last will and testament of RICHARD T. GRAVES Decd. be probated, and that the said MARY JANE GRAVES be appointed as Executrix of the same and that Letters be granted her after she executes Bond for seven Thousand Dollars for her faithful performance of the same it is further ordered by the court that JOHN K. BUMPASS, JOHN McMINN & CARNSON BRAND (?) be appointed appraisers to appraise the property of the said Estate.

DUNCAN Decd. and it appearing to the court that Notice had been given as required by law it is therefore ordered by the court that the said PERMELIA DUNCAN be and she is hereby appointed Administratrix of the Said Estate and that Letters be granted her when she executes bond for Five hundred Dollars for her faithful performance as administratrix.

 

Estate of PETER E. ROBERTS Decd.

 

 

On this day comes DAVID B. DAVIS & MANDADAY DAVID Administrator & administratrix of the Estate of PETER E. ROBERTS Deceased by Petition praying the Court for an order to sell the Property belonging to said Estate to pay the indebtedness of and the expenses of Administration of said Estate and to have set apart certain property for the support of the widow & children of said Deceased as a part of her yearly allowance and to have set apart to the widow and children of said Deceased the property exempt from forced sale or Execution.

Ordered by the court that all property belonging to the Estate of PETER E. ROBERTS Decd. exempt from forced sale or execution be set apart for the use and benefit of the widow & children of said Deceased, also that the property prayed for by the Petitions to wit One (1) 1 year old Pony mare one 2 year old Blaso (?) mare and 4 year old Bay mare one shot Gun muls (mules?) & amles of wagon & one small set of wagon Irons br. (?) set apart for ino (?) support of the widow & children as a part of her yearly allowance further ordered by the court that a sufficient amount of Property belonging to said Estate be sold for cash in hand to public outcry to the highest bidder to pay the Expenses of Administration.

Also a sufficient amount be sold at public outcry to the highest bidder for a credit of 12 month to pay the indebtedness of said Estate taking note and two good and sufficient Securities.

 

Estate of VIRGINIA T. BOUNDS

 

At this day come into court VIRGINIA T. BOUNDS one of the minor heirs of J. M. & ELIZA BOUNDS Deceased being 14 years….

Ordered by the court that M. S. BOUNDS former Guardian set over and that ANN S. HURT be appointed Guardian of the Person & Estate of VIRGINIA T. BOUNDS and that Letters be granted her when she executes bond for her faithful performance.

 

Estate of THOMPSON & ABIGAL HELMS

 

At this day comes JAMES HELMS by petition one of the heirs of THOMPSON & ABIGAIL HELMS Deceased, praying the court for an order for Partition and Distribution of said Estate and the Court being satisfied that the citation required by law has been given and no reason why same Estate should not be distributed.

It is ordered by the Court that A. T. ROBINSON, GRANDERSON SHAWVER and J. S. NOBLES be and they are hereby appointed commissioners to partition and distributed said Estate between JAMES HELMS, AXIA ANN HELMS, GEORGE W. HELMS, SARAH E. HELMS, FRANCES M. HELMS, WILLIAM HELMS & JOHN HELMS, all the real and personal Estate equally between such heirs consisting of Six Hundred & forty acres of land and Fourteen Hundred & fifty Three dollars & Seventy five Cents (special) now in the hands of W. W. HERRON Guardian of the said minor heirs which amount to be equally divided among such heirs after deducting all cost of Partition &c.

The said Commissioners will set apart the interest of the deceased heirs to wit JOHN HELMS & WILLIAM HELMS and then shall proceed to distribute the shares given to the said deceased heirs equally among the Surviving heirs.

The court then proceeds to a certain the amount of advancement that has been made to each heir and it appearing that that they have received as follows AXIA ANN HELMS has received one hundred & thirty four Dollars & fifty nine cents ($134.59)

It is further ordered by the court that W. H. HERRON Guardian of the said minors (unreadable) represent their interest and receive their shares.

The said Commissioners will proceed to distribute said property according to that (?)…

Estate of JOHN W. PARKER Deceased

 

This day comes W. C. PARKER administrator of the Estate of JOHN W. PARKER Deceased and the Notice of application for final Settlement having been given according to law the Court proceeded to consider the account of the said administrator and after duly examining the vouchers produced It is ordered by the court that the Said account be approved and allowed excepting the sum of Six Dollars paid to (blank) LEAR/LED. It is further ordered and adjudged by the Court that the said W. C. PARKER be allowed his administration account to the amount of fifty one Dollars as commission and compensation then comes on to be heard the application of the said W. C. PARKER for Partition and distribution of the Estate intestate JOHN W. PARKER Deceased and it appearing to the Court that all of the debts against Said Estate have been paid and no reason appearing why said Estate should not be distributed It is ordered by the Court that GEORGE WHITE, SAMUEL WILKINS and WILLIAM SACHSE proceed as Commissioners to partition and distribute Said Estate between MARY E. PARKER the surviving wife of said JNO. W. PARKER and the following married (?) heirs to wit W. C. PARKER, MRS. M. J. PARKER in right of her husband Deceased to wit THOMAS PARKER, SARAH WILSON & heir of DAVID PARKER Deceased, ELIZA SIDWELL, SAMUEL PARKER, heirs of LOUISIANA (?) PARKER deceased, M. E. PARKER JR., LAWRENCE PARKER, LAURA B. PARKER and DESDEMONIA PARKER as follows one half to be equally divided between the afore said heirs and such property as may appear upon the Inventory as follows of all the said Estate one third for (?) life to be given to MARY E. PARKER deceased and of the person and Estate one third to be given to said widow and the remainder of both real and personal property of the Separate Estate to be divided equally among the aforesaid heirs the court then proceeded to a certain the advancements and it appearing that they have received as follows: W. C. PARKER 157.50 THOMAS PARKINS [PARKER?] Widow M. G. PARKER $145 Also amount due on Note to the Estate $111. Lot at $156 SARAH WILSON $155, DAVID PARKER Decd. One Stud (?) (unreadable) to be placed in (unreadable) SAML. PARKER $20. In addition to the advancement to W. C. PARKER there shall be deducted from his share the sum of $60 15/00 amount due by him to the Estate for the hire of Negro, also deduct from the Share of the Widow M. E. PARKER the sum of $14 due the Estate for hire of negro.

The said commission will set apart the interest to the Two deceased heirs to wit DAVID PARKER and LOUISIANA PARKER and than shall proceed to distribute the Shares given to the said Deceased as follows of the share of DAVID PARKER shall be given to W. C. PARKER, SARAH WILSON, ELIZA SIDWELL and SAMUEL PARKER, Brothers and sisters of the full blood one full Share each and to M. E. PARKER JR., LAWRENCE PARKER, LAURA B. PARKER and DESMONIA PARKER Brothers and Sisters of the half blood an half share each, of the share of LOUISIANA PARKER her mother MARY E. PARKER shall receive one half and the other half to be given as follows to her Brothers & Sisters of the full blood, to wit M. E. PARKER JR., LAWRENCE PARKER, LAURA B. PARKER and DESDOMIA PARKER one share each and to the brothers and sisters of the half blood to wit W. C. PARKER, SARAH WILSON, ELIZA SIDWELL and SAMUEL PARKER an half share each.

The said commissioners will proceed to divide said property as given so that inventory of said Estate in accordance with the foregoing order and report that next term of the court.

And it is further ordered by the court that W. C. PARKER be appointed (unreadable) ad litem of SAMUEL PARKER minor.

On this day comes D. B. DAVIS & MANDAY DAVIS Administrators of the Estate of PETER E. ROBERTS Deceased and prays the Court for an order of sale of Lands belonging to said Estate.

Ordered by the court that the said Administrator & administratrix proceed to sell at public outcry to the highest bidder on a credit of 12 (months) at the Court House Door in the Town of McKinney on the 1st Tuesday in January 1866 the following Real Estate belonging to said Estate to wit: Eighty (80) acres of Land situated in Survey of JAMES T. ROBERTS also Fifty 50 acres of land situated in Denton County being part of the Bredgs (?) [Brazos/Bridges?] taking note & good & sufficient security.

At this day comes MILES GRAVES by petition and prays the court for appointment of commissioners to make partition of the community property belonging to the Estates of JOHN UPSHAW Deceased.

Ordered by the court that HARMON BRUMETT, JOHN M. COPE, JAMES M. COPE be and they are hereby appointed Commissioners to make partition of the community property belonging to the Estate of JOHN UPSHAW Deceased said Commissioners will (unreadable) to partition said Estate and report to this court according to law.

 

Estate of J. D. NELSON Deceased

 

At this day comes A. H. NATHERLY Admr. of the Estate of J. D. NELSON Deceased and by petition prays for the appointment of Commissioners to Set apart to its (?) Surviving wife of said Deceased her interest in said Estate that the remainder may be sold for the payment of Debts.

And it appearing to the court that the whole of said property is separate property and consists entirely of land It is therefore ordered by the court that D. D. GRHAM, JACOB MOORE & J. O. SHEPPARD be and they are hereby appointed Commissioners to set apart to the surviving wife of said Deceased a life interest in one third of said Estate with exception of seventy five acres of land that is under mortgage to J. W. HAYNES (?) and for description of said lands, references is here made to the Deed to LUCIE (?) NELSON deceased and Inventory of said Estate the said (unreadable) to partition said Estate in accordance with the order of court taking into consideration quality and quantity and making report to the next term of this court.

Estate of JONAS DAWSON Deceased

 

At this day comes D. D. DAWSON, J. D. DAWSON and NANCY HUFF the only heirs at law of JONAS DAWSON deceased by petition and pray the court for Partition & Distribution of said Estate and it appearing to the Court that said heirs have obtained the full and entire release from CHARITY DAWSON the widow of said JONAS DAWSON Deceased both separate and community.

It is therefore ordered by the court that A. T. ROBERSON, J. S. HELMS & W. J. ROBERTS be and they are hereby appointed Commissioners to make partition and distribution of said Estate among the following heirs to wit: DANIEL D. DAWSON, JAMES D. DAWSON & MARY HUFF all the real and personal Estate equally between said heirs consisting of 287 acres of land the Headright (?) of said Deceased also 276 acres of timbered land part of the Headright survey of THOMAS LINDSEY Situated on the waters of East fork and all other personal property belonging to said Estate for particular description of which reference is (unreadable) made to Inventory appraisement of said estate.

The said commissioners will proceed to distribute said Estate in accordance with the order of this court (unreadable) into consideration quality & quantity & report[ing] to the [court] the next time [term?] of the court.

 

Estate of R. C. WHISENANT Deceased

 

At this day come HUGH WHISENANT by petition and prays the court for an order of sale of sufficient property belonging to said Estate to pay off the indebtedness of said Estate.

Ordered by the court that HUGH WHISENANT Admr. of the Estate of R. C. WHISENANT proceed to sell at public auction for cash in hand to the highest bidder the following property belonging to said Estate to pay the cost of Administration amounting to about fifty Dollars, also a sufficient amt of Personal property to pay off the indebtedness of said Estate on a credit of six months to the highest bidder taking Notes and good sufficient security.

At this day comes J. K. H. PACE Admr. of the Estate of ELI W. WITT Deceased in vacation and pray the Court for an order of sale for Certain personal Property belonging to his intestate, Three Horses and all other personal Property and it appearing to the court that since property is wasteful & expensive (?) to said Estate.

It is therefore ordered by the court that J. K. H. PACE Admr. of the Estate of ELI W. WITT proceed to sell at Public outcry to the highest bidder (3) Three Horses and all other personal Property belonging to his intestate liable to waste on a credit of Twelve months for all sums of Five Dollars and over and for cash in hand for all sums under Five Dollars taking Note and approved security from purchasers and report his action there at the next term of this court.

At this day comes W. C. PARKER Admr. of the Estate of J. W. PARKER Deceased and makes his report of the selling of 7 acres of land and one Town lot belonging to his intestate and the court proceeded to examine said account of sale and it appearing to the court that said sale was fairly made and in accordance with the order of this court and in conformity with law, it is therefore ordered (unreadable) by this court that said account of sale be and it is hereby confirmed and that the same be recorded by the clerk and that conveyance be made to purchaser or purchasers of said lands as reported in said account of sale vesting the right and title that the said J. W. PARKER Deceased had in and to said land at the time of his Death.

At this day comes J. S. HEARN Admrs. of the Estate [of] C. C. HEARN Decd. and prays the Court for appointment to [for?] appraisers to appraise the Estate of said Decd.

Ordered by the court that R. M. RIDDLE, E. CAMMON & T. T. BRADLY be and they are hereby appointed appraisers to appraise the Estate of C. C. HEARD Deceased and report to this court according to law.

 

Estate of ELIZABETH CHENOWORTH Minor

 

At this day comes JOHN C. BATES Guardian of ELIZABETH CHINOWORTH and represents and shows to the court that his ward has arrived a lawfull (sic-lawful) age and prays the court for final Settlement and to be discharged from said Guardianship and it appearing to the court that Notice of the same has been given according to law the court proceeded to consider the account of said Guardian and after duly examining the vouchers produced It is ordered by the Court that said account be approved and allowed and that Said Guardian be allowed the further sum of Five Hundred ($500) Dollars for extra Services as such Guardian in perfecting the title to the lands belonging to his wards Estate And it is further ordered adjudged and decreed by the court that Said BATES be and he is hereby finally discharged from said Guardianship.

Estate of J. W. [JOHN W.] & CATHARINE SMITH Deceased

 

At this Term of the court comes on to be heard the petition of E. B. SMITH [AMELIA “MILLIE” B. COOPER SMITH?] Surviving Widow of J. W. SMITH Deceased in her own right and as Guardian of her infant child LUCENTICE [LUCRETIA?] L. SMITH and prays the court for partition and distribution of the estate of J. W. and CATHARINE SMITH Deceased and it appearing to the court that all other parties interested has (have?) been cited according to law to show cause why said partition should not be made and no one objection being made It is therefore ordered adjudged and decreed by the court that the prayer of petitioner be granted and that STEPHEN JONES, G. B. KERR, J. T. COLEMAN and W. A. RHID be and they are hereby appointed commissioners to partition and distribute said Estate among the following heirs to wit E. B. SMITH Surviving wife of said Deceased and her child LUCRETA L. SMITH, minor MARITHID [MARTHA?] A. DUNCAN, MARGARITT SCOTT, McKINDRIE SMITH & ALFRED FOX SMITH, JANE SMITH and CATHARINE B. SMITH minors all residences of Collin County, Texas and SARAH LINDSEY resident of Denton County and of the following claimants it appears that CATHARINE B. SMITH is a minor with any lawful Guardian and also that LUCENTICE [LUCRETIA?] L. SMITH is a minor whose Guardian is entitled to a portion of said Estates. It is therefore ordered by the court that W. H. ANDREWS be appointed ad litem to represent the interest of said minors CATHARINE B. & LUCRETIA L. SMITH. And it appearing to the court that said Estate consists of 290 acres of land and $1769.69/100 in Notes non (now?) in the hands of J. O. STRAUGHAN Admr. of said Estate the proceeds of the sale of the personal property belonging to the said Estate from which is to be deducted Two hundred & twenty five Dollars and Twenty five cents and placed into hands of said Administrator for the purposed of paying the indebtedness of said Estate and the cost of Administration. And it further appearing that all the property of said Deceased J. W. SMITH both real and personal belonging to the Community of his first marriage with CATHARINE SMITH Deceased it is therefore ordered by the court that said commissioners divide all of said property both real and personal into two equal portions and that they assign to MARITHID [MARTHA?] A. DUNCAN, MARGARITTE SCOTT

SARAH LINDSAY, McKINDRIE SMITH, ALFRED FOX SMITH, JANE SMITH and CATHARINE SMITH the children of said first marriage in equal share the one half of all said lands and person(al) Estate they [then?] shall assign to said Surviving widow E. B. SMITH a life interest in one third of one half of said land with remainder after said life estate to all the children of said Deceased in equal Shares and by further assigning to said Surviving widow and third of said one half of said personal Estate in full property and of the other two thirds of the said one half of personal estate to be equally divided between all the children of said Deceased Said commissioners will proceed to partition said Estate according to the order of this court taking into consideration any advancements that may have been made to each heir and report to this court according to Law.

Collin County Special Term June 12 1866

 

VIRGINIA C. McGREGOR

 

At this day information in writing being given to the Chief Justice of said County that VIRGINIA C. McGREGOR is non compus mentis whereupon the court cause twelve good and lawful men to be summoned as jurors to be and appear before him intanber (?) to inquire into the som_____? of the mind of the said VIRGINIA C. McGREGROR being brought into Court and the Jury after hearing the testimony touching the soundness of the mind of the Said VIRGINIA C. and the placing of the Said VIRGINIA under restraint Brought in the following verdict:

We the Jury are of the opinion that VIRGINIA C. McGREGOR is not of sound mind and that she should be place under restraint.

J. O. STRAUGHN, Foreman

It is therefore ordered adjudged & decreed by the court that the said VIRGINIA C. McGREGOR be placed under restraint and sent to the Lunatic Asylum of the State of Texas.

And open further inquisition it appears to the court that Said VIRGINIA C. McGREGOR has no family and no available Estate and that she has a Father who is in indigent circumstances and is not able to support her.

At this day comes S. COFFEY by petition and prays the court for Letters of Administration on the Estate of R. C. COFFEY Deceased ordered by the court that Said S. COFFEY be appointed Administrator of Said Estate and that Letters be assign[ed] him when he gives bond for his faithful performance.

 

Estate of CATHARINE SMITH Deceased

 

At this day comes H. A. DUNCAN be petition and prays the court for Letters of Guardianship of the person and Estate of CATHARINE SMITH minor heirs of J. W. & CATHARINE SMITH and it appearing to the court that Notice has been given according to law it is therefore ordered by the court that the said DUNCAN be appointed Guardian of said minor and that Letters be issued him when he give bond for his faithful performance &c.

 

Estate of SAML. McREYNOLDS minor

 

At this day comes MARY STANDIFER by petition and prays the court for Letters of Guardianship of the Estate of SAML. McREYNOLDS minor heir of J. M. McREYNOLDS Deceased and it appearing to the Court that Notice has been given according to law it is therefore ordered by the court that said MARY STANDIFER be appointed Guardian of the Property of said minor and that Letters be issued her when she given bond for her faithful performance.
