At this day comes W. M. WEAVER and returned new (?) Inventory and appraisement of the property belonging to the Estate of MATILDA ANN & ISEBELLY WHISENANT minor heirs of R. C. WHISENANT Deceased.

 

Estate of JOSIAH JACKSON minor

 

At this day comes THOMAS S. BROWN by petition and prays the court for authority to receive property for payment of a Note due his Wards Estate from E. M. ELLIS? and it appearing to the court that it is (unreadable) interest of said Estate It is therefore ordered by the court that Said T. S. BROWN be and he is hereby authorized to receive good property in payment of said note at fair valuation.

WHISENANT deceased and in writing made their report of Partition and distribution of said Estate and the court proceeded to Examine Said Report of Partition & Distribution of Said Estate and it appearing to the Court that said partition & Distribution has been fairly made among the heirs of said Deceased It is therefore ordered adjudged and decreed by the court that said partition and distribution be in all things confirmed and that the same be Recorded by the clerk.

 

Estate of R. C. WHISENANT Deceased

 

It is ordered by the court that ALEX BERRY who is appointed at a former Term of this court Attorney to represent MARITHIA STOCKTON non resident distributee in the partition of the Estate of R. C. WHISENANT Deceased be allowed the Sum of Ten Dollars for his Services in the said partition to be charged on the share of said MARITHIA STOCKTON.

Estate of J. J. MILLER Deceased

 

It appearing to the Satisfaction of the court that J. J. HARRISON administrator of the Estate of J. J. MILLER Deceased has absented himself from the limits of the State of Texas for a period exceeding Three months without the permission of this court. It is therefore ordered adjudged & decreed by the court that his Letters of Administration on said Estate be and they are hereby revoked.

 

Estate of JONAS DAWSON Deceased

 

The Heirs of JONAS DAWSON Deceased having heretofore given bond for the payment of debts against the said Estate and the said property having been partitioned and Distributed, It is ordered by the court that the account of final Settlement filed by J. M. CHIPMAN be and Same is hereby approved and the said CHIPMAN account for commissioners and attorney’s fees is hereby allowed and the Said J. M. CHIPMAN having none of the assets of said Estate in his hands is hereby discharged from said Administration.

 

Estate of JAMES & M. C. HENDRIX Deceased

 

At this day comes D. D. GRAHAM Administrator of the Estate of JAMES & M. C. HENDRIX by petition praying the court for an order of sale of the following personal property belonging to said Estate to wit: one Pony mare & yearling colt, one or two cows & calves & yearlings, the balance of the corn and all other articles to be to wast[e].

And it appearing to the court that said property is liable to wast[e] and is expensive to said Estate it is therefore ordered by the court that D. D. GRAHAM Administrator of said Estate proceed to sell as early as practicable to the highest bidder for cash in hand the above mentioned personal property belonging to said Estate and report to this court according to law.

Estate [of] C. C. HEARD Decd. whereas it has been made Known to the court that GEORGE M. WATTS purchased of C. C. HEARD Decd. and [a] certain [unreadable] lots in the Town of McKinney Known as lots No. (blank) in Besck (?) No. 70 for which no Deed has been made and the Administrator having acknowledged the payment of the [unreadable] money It is therefore ordered by the court that JOHN S. HEARD Administrator of said Estate make to said GEORGE M. WATTS a good and Sufficient Deed for Said lots as prayed for in his petition.

Also all the personal property remaining in the hands of said Administrator for particular description of which referenced here made to the Inventory & appraisement.

Said commissioners will proceed to distribute Said Estate by assignment to each heirs of said Estate an eighth share of all the notes & personal property above mentioned.

On this day comes the Commissioners appointed by this court to make partition and distribution of the Estate of J. W. & CATHARINE SMITH Deceased and report the Lands directed in Said order of appointment to be portioned among the heirs of Said Estate and not Susceptible of division without material injury to the heirs of said Estates, and recommending to the court the sale of said land fixing a value of the same at Eighteen hundred ($1800) Dollars and none of the heirs taking said lands at the appraised value It is therefore ordered adjudged and Decreed by the court that the Administrator of said Estate proceed to sell Said lands on the 1st Tuesday in October (line drawn though first September than October) 1866 at the Court House Door in the Town of McKinney at public out cry to the highest bidder on a credit of 12 months for specie or its equivenient in currency, taking note and good personal Security of the purchaser or purchasers and him (?) on the promise to secure the payment of the purchase money, first giving Notice of the time and place of sale required by law.

At this day information in writing having been given to the County Judge of said County that ELIZABETH BUTLER is a non compus mentis whereupon this caused Twelve good and lawful men to be Summoned as Jurors to be and appear before him (unreadable) to inquire into the soundness of the mind of the said ELIZABETH BUTLER and the Jury being duly impaneled and sworn and the said ELIZABETH BUTLER being in open court and the Jury after hearing he testimony touching the soundness of the mind of the said ELIZABETH BUTLER, and the placing the said ELIZABETH BUTLER under restraints, Brought in the following verdict,

“We, the Jury agree that ELIZABETH BUTLER is of unsound mind and that she needs protection from some source.”

It is therefore ordered adjudged and Decreed by the court that the said ELIZABETH BUTLER be placed under restraint and sent to the Lunatic Asylum of the State of Texas.

And it appearing to the Court that Notice has been given according to law, and no one appearing to the Court that Said minor is a minor (freedboy) of the age of Twelve years and it further appearing to the Court that said minor has no Parents or Estate from which to derive a support It is ordered by the court that the said minor BOB WILSON be apprenticed…
