And it appearing to the court that Notice has been given according to law and no one appearing and contesting the same And it further appearing to the court that Said minor BEN RHINE (unreadable) Estate from which to derive a support and that his mother his only Parent, is an idiot, and incompetent to support him it is therefore ordered by the court that the Said minor (Freedboy) BEN RHINE be apprenticed to the Said J. On this day comes JOHN K. BUMPASS Administrator de bonis non of the Estate of R. D. BUMPASS Deceased praying for an order of Court authorizing him to sell one hundred fifty Three acres of [land] belonging to Said Estate, and it appearing to the Court that it is necessary to sell said land for the purpose of paying the debts against said Estate it is therefore ordered adjudged and Decreed by the Court that JOHN K. BUMPASS Administrator as aforesaid proceed to sell said one hundred and Fifty Three acres of land at the Court House Door in the town of McKinney to the Highest bidder on the 1st Tuesday in July 1857 on a Credit of (blank) months after giving notice of said sale according to law taking note and Security from the purchaiser [purchaser] and lien on the land for the purchase money, And make report to this Court on or before the (unreadable) Term thereof.

STUART to DAVID WETSEL on the 2nd of January 1858 and Recorded in Book L Page 233 at the Collin County Records and valued on the Inventory of said Estate at One Thousand Dollars.

On this day come(s) M. R. PARRISH Administrator of the Estate of J. W. WALSH Deceased by petition praying the Court for an order authorizing him to sell the following Real Estate belonging to the said Estate To wit Lots No. 238 & 239 in Block 69 in the Town of McKinney and reappraises and shows to the satisfaction of the court that said Lots were (?) during the life time of said Deceased conveyed to T. T. BRADY be (?) Decd. of First to Secure the payment of Two certain promissory Notes. It is therefore ordered by the Court that M. R. PARISH Administrator as aforesaid proceed to sell at the Court House Door in the Town of McKinney on the 1st Tuesday in July next at Public outcry to the highest bidder on a credit of six months the above described Lots for the purpose of satisfying said Notes and cost of Administration after giving Notices according to Law.

At this day comes the administrator of the Estate of the JAS. S. BRADLEY decd. and prays that Partition and distribution of said estate be made among the heirs of said estate and it appearing to the Court that there has been property enough belonging to said Estate so to pay all the indebtness of said Estate, It is therefore ordered by the Court that said Estate be partitioned and distributed among the heirs of said Estate to wit, CHARLOTTE SPURGEN [SPURGIN] the Surviving wife of said deceased, MARY BRADLEY, EMMA BRADLEY and WILLIAM BRADLEY, and that J. O. STRAUGHAN is hereby appointed Guardian ad litum of the said MARY, EMMA and WILLIAM BRADLEY and that JAS. H. LOVEJOY, GEO. WHITE, S. G. FURGUSON and JOHN FAIRES be and they are hereby appointed Commissioners to make partition and distribution of said estate among the aforesaid named heirs to CHARLOTTE SPURGEN they will set apart one half of all the Community property belonging to said estate and one third of the separate property of said deceased, the remainder they will made an equal distribution among the above named children MARY, EMMA and WILLIAM BRADLEY taking into consideration quantity and quality, and for description of the property belonging to said Estate referenced here had to the Inventory and title papers of said Estate.

SMOOT and by petition prays for the probate of said will and testament and it appearing to the court that notice for the probate of said will had been given as required by law and EDWIN KEY (?) one of the subscribing witnesses appearing in open court and due form of law makes oath that W. B. SMOOT executed the same ordered by the court that the same be recorded and that letters issued to the executors therein named.

WILKERSON executor of the last will and testament of MILTON WILKERSON deceased and by petition prays for the probate of the same and it appearing to the court that notice of the probate of the same had been given as required by law and THOMAS J. NELSON late of Collin County deceased in his lifetime to wit on the fifth day of August A. D. 186? Executed in due form of Law said mortgage and therefore delivered the same to the said JOHN W. HAYNES whereby the said decedent in his life time as aforesaid granted and conveyed to the said JOHN D. HAYNES a certain tract or parcel of land lying in Collin County on Indian Creek about 18 miles East of the town of McKinney and described as follows to wit one half of one hundred and fifty acres in the south part of a Survey Known as the SUSANA WALKER Survey together with all the appurtenances thereon now in the possession of the Estate of Said decedent upon conditions that promissory note of seventy three 44/100 dollars to wit the note aforesaid the value being made by the said decedent payable to the said JOHN W. HAYNES bearing (?) even date with the day and year aforesaid and due one day thereafter And it further appearing to the court that Said promissory note although just and long since due is wholly unpaid and that the same as well as the lien of said mortgage has been duly allowed by A. H. NEATHERLY administrator of the estate of Said decedent and said allowance approved as required aforesaid has been duly served as the law directs with a law___(unreadable).

Estate of ELIZABETH YARNELL deceased

 

Now this day comes into open Court SILAS YARNELL surviving husband of ELIZABETH YARNELL deceased and returned unto Court an inventory and appraisement of the community property of himself and his deceased wife duly sworn to by two of the appraisers appointed by the Court and also by his own affidavit.

Ordered by the Court that the same be approved and that the Clerk place the same upon Record.

 

Estate of JOHN MARSHALL deceased

 

Now this day comes W. P. MARSHALL Executor of the last will and testament of JOHN MARSHALL decd. and returned into Court an inventory and appraisement of the Estate of the said JOHN MARSHALL deceased.

Ordered by the Court that said Inventory and appraisement be approved and that the Clerk enter the same upon record.

 

Estate of JOHN MARSHALL Deceased

 

Now this day comes W. P. MARSHALL executor of the last will and testament of JOHN MARSHALL decd. and represents to the Court by Petition that there are certain debts due against the Estate of JOHN MARSHALL decd. and asks that the personal property of said Estate Subject to sale be offered at public vendue [venue?] to the highest bidder on a credit of ten months to discharge Said indebtedness and also that Commissioners be appointed to Divide the Separate property of said Estate.

Ordered by the Court that Said prayer be granted and that the Said Executor be ordered to sell said property as asked for in said petition and I. W. J. FRANKIN, M. J. BYLESS & I. A. STINSON (?) be and are hereby appointed said commissioners.

 

JAMES HENDRIX Estate Minor

 

Now this day comes JACOB MOOR [MOORE?] guardian of JAMES HENDRIX minor and represents to the court that no money or property has come into his has [hands?] as such guardian and that said ward died about month of January last.

Estate of JOHN D. LEADBETTER [LEDBETTER] deceased

 

Now this day comes JAMES T. COLEMAN administrator of the Estate of JOHN D. LEDBETTER decd. and reports that in obedience to an order of sale made at the January Term 1868 of said Court to sell so much of the land belonging to the Estate of JOHN D. LEADBETTER deceased as would be necessary to pay off the debts due by said Estate and the expenses of administration on same he after advertising the Same according to law did by JAMES H. LOVEJOY auctioneer on the 3d day of March 1868 proceed to sell 75 acres of land belonging to said Estate and patented in the name of B. P. WORLEY. Said land to be Surveyed in a square or as near thereto as may be practicable and W. H. ANDREWS agent for S. I. (?) COLEMAN being the highest bidder said land was Sold to him at the price of One Dollar per acre and said purchaser having waived the Credit and paid the purchase money unto Court requests (?) that the Court ratify Sale and order Conveyance to be made to the purchaser in accordance with the Statute in Such Cases.

Whereupon it is ordered by the Court that sale be Confirmed and that the administrator be Ordered to make deed to purchaser as in Such Cases made and provided by law.

 

Estate of JOHN & LYDIA GRAYUM decd.

 

Now this day comes J. D. GRAYUM admr. of the JOHN & LYDIA GRAYUM deceased and makes his annual Report under oath of the Condition of said Estate.

Ordered by the Court that the same be and is hereby approved.

 

Estate of WILLIAM JONATHAN GRAVES a minor

 

Now this day comes JONATHAN GRAVES and represents to the Court that WILLIAM JONATHAN GRAVES a minor Son of ALFRED GRAVES who is yet living and MARY GRAVES (formerly MARY BAKER) who is deceased that there is money due said minor in the State of Missouri Amounting to about $150 and asks the Court that he be appointed Guardian of said minor.

Therefore it appearing to the Court that notice has been given and [no] objection having been made It is ordered that the said JONATHAN GRAVES be and is hereby appointed Guardian of the Estate of said WILLIAM JONATHAN GRAVES minor as aforesaid upon his given (sic) Bond in the Sum of three hundred dollars.

 

Estate of LOUIS SHIRLEY deceased

 

This day comes ALEXANDER BERRY administrator of the Estate of LOUIS SHIRLEY deceased and represents to the Court that for certain reasons set forth in his petition – asks the Court for sixty days more time to return his inventory in said Court. Ordered by the Court that said BERRY admr. as aforesaid have Sixty days time to return Said inventory.

 

Estate of J. E. BRYANT decd.

 

Now this day comes THEODOSIA BRYANT & THOMAS P. TEAGUE in open Court and prays the Court for the appointment of administratrix and administrator of the Estate of J. E. BRYANT late of Collin County deceased and it appearing to the Court that due notice had been given and no objection being made to said appointment. It is ordered by the Court that said THEODOSIA BRYANT and THOMAS P. TEAGUE be and are hereby appointed…

Estate of H. H. GOSSIN deceased

 

Now this day comes C. T. MANN and represents to the Court that H. H. GOSSIN died in the year 1862 intestate as he verily believed and that there is no administrator in said estate – and asks the Court to appoint him administrator of said Estate. Thereupon It appearing to the Court that due notice has been given and no one appearing to object to the same It is ordered by the Court that Said C. T. MANN be appointed Administrator of Said Estate. And that (blank) OGELSBY, JOHN LOVELESS, [and] F. J. VANCE be appointed appraisers to appraise to [the?] property of said Estate.

 

Estate of T. B. MORGAN decd.

 

Now this day comes MRS. (blank) MORGAN wife of T. B. MORGAN Decd. by her attorney and asks the Court to make due allowance for the maintance of herself & infant children & for the homestead to be set apart for her.

Ordered by the Court that MRS. (blank) MORGAN be allowed the sum of four hundred dollars for her support for one year and that the administrator be ordered to set apart to said MRS. MORGAN the homestead and other property exempt to her by law.

 

Estate of W. E. SMOOT, decd.

 

Now this day comes F. J. VANCE Executor of the Estate of W. E. SMOOT and returned into Court a bill of Sale of the personal property of said Estate.

Ordered by the Court that the same be and is hereby approved and the Clerk ordered to record the same.

 

Estate of T. B. MORGAN decd.

 

On this day comes into Court S. B. DICKERSON [DICKINSON] Admr. of the Estate of T. B. MORGAN decd. and returned an inventory and appraisement of said Estate.

Ordered by the Court that said Inventory and appraisement be approved and the Clerk ordered to place the Same on Record.

[Estate of D. M. CRUTCHFIELD]

 

Now this day Comes S. BOWLBY Executor of the Estate of D. M. CRUTCHFIELD deceased and thereupon Comes Two of the County Commissioners of Collin (Smear) County to wit JOHN M. KINCADE and JOHN SCOTT and the said BOWLBY presents to said Court a prepresenting (?) that there is no property belonging to (smear-make?) the allowance made to herself and child[ren] and asks that an order be granted to sell so much of the Estate of said deceased as will be sufficient to raise the amount of money So allowed to said widow and children For Cash in hand.

Ordered by the Court that said prayer be granted and that Said Executor be allowed to sell sufficient amount of property to Pay said Allowance.

 

Estate of R. KILGORE deceased

 

Now this day come W. G. PENDLETON admr. of the Estate of R. KILGORE deceased and made his annual Report as admr. of said Estate.

Ordered by the Court that said report be approved.

 

Estate of SAMUEL WHITAKER decd.

 

Now this day comes BUFORD HENRY by petition and represents to the Court that SAMUEL WHITAKER formerly a citizen of Collin County and [died?] in the month November 1863 and that there are debts due to and from Said Estate – and that there is no administration on said Estate – and that upon request of same of the creditors of the Estate he prays that Letters of Administration be granted him as admr. of Said Estate.

Therefore the Court being Satisfied that due notice has been given and no one objected to the same it is ordered by the Court that said BUFORD HENRY be and is hereby appointed Administrator as aforesaid and that ARCHABALD WHITE, JOHN CHOAT and WM. GARNETT be appointed appraisers of the property of said Estate.

 

Estate of JAMES SMARR decd.

 

This day comes BUFORD HENRY Executor of JAMES SMARR decd. and asks the Court to grant to him further time untill (sic) the next term of this Court to return inventory of said Estate. Whereupon the Said prayer is granted by the Court.

 

Estate of CHARLOTTE SPURGEN for letters of Guardianship of her infant Children & removal of T. T. BRADLY [BRADLEY] [as] Guardian

 

By order of the Court this Cause is Continued until the first day of the next term.
