MALLOW admr. of said Estate would represent that in obedience to an order of your honorable Court made at the last term thereof he proceeded to sell at public outcry to the highest bidder the lands therein described after advertising according to law at the Court House door in the town of McKinney Collin County on the 1st Wednesday in Feby. 1875 the same being the 2nd day thereof when GEORGE A. WILSON bid therefore the sum of 6.50 Dollars per acre making the aggregate $1664.00 which being the highest and best bid the same was knocked off to him. He submits to the court whether the same was sold for its reasonable value & whether he shall make deed therefore & take note & mortgage as required by Law.

Reporter would represent that the holds note against M. A. & C. V. SPRINGER for $185.65 with ten per cent int. for the 19TH Sept. 1864 to be deducted from the interest of said C. V. SPRINGER as an heir of M. & C. MALLOW upon a prior settlement of said Estate said C. V. SPRINGER is now deceased leaving heirs minors, T. T. BRADLEY guardian and in the portion of the money on hand there was found to be due said heirs the sum of $132.57 he asks that he be ob____ed (?) to credit said _____s (?) on the note aforesaid & disprobate (?) the same amongst the surviving heirs of M. & C. MALLOW entitled thereto. Also another note against same parties for the sum of 1275$ with ten per cent interest from maturity dated Dec. 25 1866 due six months farther represents that the notes against the other heirs heretofore reported been settled and paid off in the partition of the money aforesaid. He further represents that the heirs of JOHN MALLOW deceased are entitled (?) to the sum of $45.05 their distributive shares in this partition of the money on hand which they have not yet recd. & the same is held for them.

He holds a note on A. C. LACY & D. MOLEY (?) dated July 18, 1863 due six months for 183.37 with credits bearing ten per cent interest from maturity, insolvent and worthless. Reporter would further represent that he has on…

Therefore represents that the gold heretofore reported was sold at a premium of $34.90 and sdrer (?) $2.80 the partition was made in currency and $14.00 of the $29.38 report in hand in this report is comm. MALLOW Dec. represents that in obedience to an order of your Honorable Court he as said administrator on the first Tuesday in July 1875 between the hours of 10 a. m. and 4 p. m. proceeded to sell to the highest bidder on a credit of twelve months the land described in said order belonging to said Estate the sum being 256 acres where JESSE ORENDUFF, JOHN H. ORENDUFF & WILLIAM ORENDUFF bid therefore the sum of ten dollars per acre aggregating $2560.00 he would further represent that this was the highest bid offered for said land and asks that the same be confirmed & approved and that he be ordered to make deed in compliance with said order.

Now your reporter represents that all the debts against the Estate of his testatrix have been paid off and he would ask that said land be turned over to him as the guardian of said ELDORA A. HUNTER and that notice required by law be given of this application, that the funds above mentioned be distributed among the persons entitled to receive them. That the administration be closed. Your reporter be discharged from his trust and for such other relief as to your honor may seem fit.

The undersigned reporter Guardian of the Estate of NANNIE H. GOSSUM a minor would report that by virtue of an order passed at the present term of said court authorized him to sell at private sale for Cash in hand certain lands belonging to his said Ward in said order described did on the 30th day of November 1875 sell to the Houston and Texas Central Railway Company at private sale for the sum of nine hundred and forty Dollars to be paid cash in hand the following described tract of land to wit situated in Collin County part of a survey of 640 acres in the name of JOSEPH KLEPPER and it being part of a tract of Eleven acres conveyed by JOSEPH KLEPPER to H. H. GOSSUM by deed band beginning at the NW corner of said Eleven Acres Thence E 8 chs. [chains] 87 lks. [links] to L. BULTER’S NW corner…

…Thence south 9 chs. 55 links a post Thence west 8 chains 87 lks. to the SW corner of said 11 acres tract Thence N 9 chs. 55 lks. To the beginnings. He further reports that he sold at the same time on the same terms to J. W. BROCK and GEORGE ELLISON for the sum of two Hundred and twenty two Dollars the following described tract or parcel of land to wit. A part of said 11 acre tract and beginning at the SW corner of the crossing of Main and Jefferson streets in said town of Plano on the west side of Jefferson Street Thence West 80 feet with the line of said Jefferson street a stake in said line thence south thirty feet a stake Thence East 80 feet a stake in the west line of said Main street Thence North 30 feet to the Beginning.

                Wherefore Reporter prays that said sale be confirmed and he be ordered to execute title to the purchasers on payment of the purchase money. There yet remains about one half of an acre to be sold.

DEER deceased would represent and show that in compliance with the order of this court rendered at a previous term hereof he as admr. of said Estate sold 103 bushels of corn in the month of January 1877 to JAS. H. JENKINS making in all $25.75 in the same month sold to (blank) ROURK 27 ½ bushels at 25¢ per bu. Making the sum of $6.87 33 bushels sold near same time to JAMES BURTOW at  25 cts. per bushel making 8 25/100 sold to (blank) PHALENS 26 bushes (sic) at 30 cts. per bushels making $7.80 sold 33 bushels to at 30 cts. per bushels making 9 90/100 amounting in all to 58 57/100 Dollars less $27 rent due on the land in which said corn was raised which this admr. has reserved for himself in accordance with the terms of contract made with DEER in his lifetime and the sum of 11 15/100 which was paid by the administrator for gathering & finishing (?) the corn it being five cents per bushel administrator who represent[s] that the corn crop brought in a net amount over and above expenses for gathering same &c rent due on land & amounting to 20 42/100 administrator would represent that in the month of January last he sold 1807 lbs. said cotton to G. M. WATTS for $2.30 per hundred amounting to $41 47/100 that he reserved for himself the sum of 13 70/100 for the rent of the land on which said cotton was grown it being the amount agreed and contracted for…

…October 27, 1873 for two hundred and ninety six and 66/100 Dollars in gold or its equivalent in currency said not was due on the 25 day of December 1874. Personally appeared before the undersigned authority JOHN COX Executor of I. J. STIMPSON decd. who on oath says that the above inventory embraces all the property belonging to the decd. that has come to the Knowledge of this affiant  since the filing of the first inventory in this estate and that it is a full inventory of all the real and personal property books papers and evidences of debts and of all debts due or to become due belonging to the Estate as far as he has been able to ascertain and that he was not bound in any Contract to the deceased at the time of her death.

                I have surveyed for her 200 acres including improvements as follows situated in Collin Co. on the waters of east Fork about five miles N. from McKinney being part of a 640 acre survey made in the name of ANDREW THOMAS and part of a tract conveyed by MARTHA ALLEN to M. W. ALLEN. Beginning at the NE corner of said tract a stake near hedge thence S 4° 30’ W 36 chs. a stake Thence S 30’ W 7 24/100 chs.[chains] a stake Thence W 28 chs. a stake from which an Elm mkd. [marked] X brs. [bears] N 45° E 4 lks. [links] Thence N 4 60/100 chs. a stake Thence W 16 chs. That he has paid the sum of one hundred & Twenty Dollars to FRED METZER & MRS. GERTRUDE METZER the natural guardians of the persons of said minors for the brand (?) of said minors for two months. That when he paid said sum of money that he personally knew that the sum was just claim against their said Estate and that he then expected to realize more from the estate of the said F. HAFNER dec. but since and after diligent endeavors he failed to procure any other sums of money or property real or personal to which said minors are entitled and he knows of no other property real personal or mixed belonging to their said Estate wherefore he asks that he be permitted to resign the guardianship of said minors and that after due notice of this his application he has been given according to law that he and his sureties be released from further liability.

Collin County                       are held and firmly bound unto the District Clerk of Collin County in the sum of Three Hundred dollars good and lawful money for the payment of which will and truly to be made unto the said Clerk we bind ourselves heirs and representatives jointly and severally by these present witness our hands this the 31st day of August 1874. The condition of the above obligation is such that whereas the above bound BENJ. S. KING has been appointed  administrator of the Estate of S. P. LEWIS deceased. Now if the said BENJ. S. In the name of God Amen.

I ISAAC STIMSON being of sound mind and memory do constitute this my last will and testament. I desire to bequeath to my wife RACHEL O. STIMSON during her natural life my homestead consisting of one hundred and seventy acres of land all my household & kitchen furniture all my stock horses cattle & hogs twenty five acres of timbered land lying in the North East corner of a hundred acre tract deeded to me by JOHN FITZHUGH twenty acres deeded to me by G. H. FITZHUGH in the SAMUEL SLOAN survey also five acres of land deeded to me by JOSEPH BLEDSOE in the MARTIN HEART survey, the remainder of the land found belonging to me I wish equally divided between all my children except AMANDA P. F. FALKNER & SOCRATES H. STIMSON to whom I have given land and other property. I wish ISAAC W. STIMSON heirs to receive one child’s part and LUCY F. ATCHISON the same the property I have given to my wife that she does not use for her support, I desire disposed of Justas the above except one acre of land including the grave yard equally divided between mine (nine?) children seven living and the heirs of the other two deceased all notes in my hands I wish disposed of as the other property. I desire to leave DAN STIMSON Executor to my will and also guardian to the heirs of ISAAC W. STIMSON & LUCY F. ATCHISON to represent them in the (unreadable) take care of their property…

I GARLAND R. MARTIN in the state of Texas and County of Collin being of sound and disposing mind and memory do make, ordain and declare this to be our last will and testament hereby revoking any forever will or wills made by me.

Item 1st. My will is that my property shall be disposed of as follows viz. to my beloved wife BETSY ANN MARTIN kindred (?) She is (unreadable)…

…at my death. I GARLAND R. MARTIN give and bequeath to said wife the sum of thirty dollars annually that being the interest of Three Hundred dollars of gold which I said MARTIN have loaned out.

I give to my daughter ANN J. BROWN five dollars. I give ISALLAR (ISABELLA?) THOMPSON five Dollars. I give my son JOHN B. MARTIN five dollars. I give my Daughter BETSY ANN ASHLOCK five Dollars.

Item 3rd I also give to my Daughter BETSY ANN ASHLOCK one wardrall (wardrobe?) one small chest one bell metal kettle one  stew pot one book Flat irons history.

Item 4th

I give to my daughter MARGARET B. BROWN five Dollars.

Item 5th

I give to my three grand children MININY M. BACCUS, RUFFUS R. MARTIN, JOHN B. MARTIN JUN. five Dollars to be equally divided between them.

Item 6th My will also is that thirty dollars of this loaned money be appropriated to the placing of tomb stones at the head and foot of my wife’s & my graves.

Item 8th

I will give to my grand son ASANAH H. WEAVER the sum of five hundred Dollars out of a legacy which is due me and which I probably will receive in y life time provided the said WEAVER pays to me in my life time the ninety dollars he is owing me if not in my life time the ninety dollars must be deducted out of the four hundred dollars that I give him.

My will is provided there should be more of my Virginia Legacy than will pay the Eight Hundred dollars that I bequeath to my grandsons A. H. WEAVER and ROBERT W. WEAVER that over pluses or balance of my legacy with the two Hundred and forty Dollars above named constitute a sum out of which the burying expenses of myself and wife are to be paid

Item 11th

I also will that if there be an over plus or more that what I have disposed of in this my will that the balance be disposed of as follows:

My will is that should there be more than what I have disposed of that the same be equally divided between my five children whose names are in this will.

Item 13th

I also give to my grand daughter MANAH THOMPSON my feather bed bedstead and furniture.

I lastly nominate constitute and appoint my grandson AZIARIAH H. WEAVER my Executor to this my last will and testament.
