Estate of JOHN FAIRES, Dec.

 

The State of Texas              I, JOHN FAIRES of said county being of sound and disposing mind and memory and

County of Collin                   desirous to settle my worldly affairs while I have strength so to do make this my last will and testament hereby revoking all others heretofore by me made.

Item 1st. I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition in life.

Item 2nd. I desire and direct that my Executors hereinafter appointed without delay pay all my just debts funeral expenses and expenses of administration out of the first money that may come into their hands of my Estate and that they cause all accounts claims and demands (?) whatever due my Estate.

Item 3rd.

                I desire and direct that all my real and personal Estate except bonds notes and accounts be sold by my Executors hereinafter appointed at the Court house door in McKinney after giving timing notice at public Auction to the highest and best bidders this personal property on a credit of six months and real Estate on a credit of one two and three years in three equal installments with interest from the day of sale at the rate of ten per cent per…

…annum taking notes with good personal security and retaining lien on the lands besides to secure the payments of the purchase money. I direct that my farm lying about one mile west of McKinney containing (86) acres be sold as above (a bare?) in One lot that my farm situated about one half mile East of McKinney containing about 70 acres be sold as above specified in One lot and that my timber land situated about one mile East of McKinney on East Fork and adjoining said last mentioned farm be divided into two lots as follows by running a line from the SE corner of the far ground (?) tract due East to the East fork of the Trinity all my land lying north of said line to be sold as above specified in one lot and all south of said line sold as aforesaid in one lot my said Executors executing good and sufficient titles to the purchasers of said lands retaining lien as aforesaid.

Item 4th. As soon as all my Just and lawful demands against my Estate shall have been paid then I desire and direct that fast as all (?) money shall come to the hands of my said Executors belonging to my said Estate ensuing from the collection of bonds notes accounts or from the proceeds or said sales of real and personal property or from any source whatever that my said Executors shall pay over and deliver the same from time to time until all of my Estate shall have been paid over and delivered to the following named persons severally to be theirs their heirs and assignees forever to wit to my son J. J. FAIRES one eighth of all my Estate, to my son THOMAS C. FAIRES one eighth of all my Estate, to my daughter…

RACHEAL A. DUGGER one eighth of all my Estate, to my son J. LEE FAIRES one eighth of all my Estate, to my daughter MARY E. WILMETH one eighth of all my Estate, to my daughter SARAH A. BROWN one eighth of all my Estate, to my son WILLIAM S. FAIRES one eighth of all my Estate and to my two grandsons OSCAR and WILLIAM FAIRES children of my son EVARE (EVAN?) C. FAIRES deceased one eighth of all my Estate.

Item 5th

                I hereby constitute and appoint my sons THOMAS C. FAIRES and J. LEE FAIRES executors of this my last will and testament with full authority to act either singular or jointly in the execution hereof and I direct that no action be had in the District Court or any other court in the administration of my Estate except to prove and record this will and approve the bond of the Executors.

…in his life time that he resided in Collin County Texas that the said FAIRES died on or about the 25th day of November 1878 that on or about the 30th day of July 1875 affiant and T. C. GOODNER signed the instrument of writing purporting to be the last will and testament of said J. M. FAIRES dec. which said will was filed in the papers of this Estate on or about the 25th December 1878 that affiant and said GOODNER signed said will of said FAIRES at his instance as witnesses to said will in the presence of said FAIRES and in the presence of each other that at the time said FAIRES signed said will he was over the age of twenty one years affiant further states that at the time of the signing of said will by said FAIRES he stated that said (unreadable) in writing was his last will and testament and that at the time said FARIES signed said will he appeared and seemed disposed to witness to be of sound mind affiant further states that at the time he and said GOODNER signed said instrut[ment] in writing they were both over the age of fourteen years.

Of Collin being of sound and disposing mind and memory and being desirous to settle my worldly affairs while I have strength so to do do make this my last will and testament hereby revoking all others heretofore by me made

 

Item 1st.

                I desire and direct that my body be buried in a decent and Christianlike manner suitable to my circumstances and condition in life.

                I desire and direct that my just debts be paid without delay by my Executrix to be hereinafter appointed.

                I Give and bequeath to my beloved brother N. B. FISHER to have until my child becomes of age whose name is T. C. FISHER there to said child all my land consisting of One Hundred and ten acres in the PETER FISHER survey also fifty acres in the BELL survey.

                I give and bequeath to my said brother one Horse described as follows to wit gray horse six years old about 14 hands high also one cow two years old red and white spotted.

                I give and bequeath to my beloved brother N. B. FISHER to raise my child T. C. FISHER.

FISHER he resides in Collin Co.—is now dead—did some time in December 1878 in said Co.—said FISHER signed the paper exhibit in court as the last will of him the said FISHER—witness & J. S. WILSON signed the same in said FISHER’S presence and at his request said instrument was read over to said FISHER & he was fully apprised of its contents before signing it at the time said FISHER signed said will which was a week or more prior to his death he was of sound mind and continued to be so up to the night before his death that being the last time witness say him he further says that said FISHER & both of said subscribing witnesses are over the age of twenty one years of age.

The condition of the above obligation is such that whereas the above bound N. B. FISHER was by the County Court of Collin County on 20th day of January A. D. 1879 appointed the Executor of the last will & testament of R. M. FISHER late of said county deceased now should the said N. B. FISHER well and truly perform all of the duties required of him under said appointment then this obligation shall be null and void otherwise to remain of full force & effect. This January A.                 I desire that my body have a decent Christian burial in the Fitzhugh cemetery as near my two dead brothers as practicable.

                I desire that my farm shall not be divided during my wife’s life but at her death the same be sold and the proceeds therefrom together with all rents that may have accrued be Equally divided with all my heirs—Embracing my children living and my children that have died and have left children that are now alive.

 

I desire that a note given to MARY LEIRES by GEORGE FITZHUGH as principale (principal?) & myself as surety be paid.

 

5th

                I hereby appoint G. W. CAMERON of McKinney Texas Executor of this my last will and testament and I desire that he take charge of all my property immediately after my death knowing that he will faithfully carry out my wishes as stated above an I further desire that there shall be no court proceedings and that the said CAMERON shall not be required to give bond as Executor hereof.

 

6th

                I hereby authorize and in power the said CAMERON to take charge of my personal property and sell the same to the best advantage and apply the same as before stated and to manage all things herein named and when my farm is sold to divide…

CAMERON signed the instrument of writing dated the 24th day of May 1878 and filed in this court by J. M. Benge clerk per P. Walton Deputy which purports to be the will of JOHN FITZHUGH dec’d. as attesting witnesses thereto at the request of the said JOHN FITZHUGH dec’d. that the said JOHN FITZHUGH signed the same instrument in the presence of affiant and the aforesaid J. E. CAMERON. Affiant further says that the said JOHN FITZHUGH was at the time of the signing of the instrument in writing aforesaid over the age of twenty one years and was of sound mind as affiant believes affiant further says that he (affiant) and the said J.                                 In the Estate of JAS. STEWART Deceased. To the Hon. T. C. Goodner County Judge of Collin County. J. M. STEWART administrator of the Estate of JAMES STEWART deceased would ask leave to report to the court that in pursuance of an order of the County Court of Collin County entered at the November term A. D. 1878 he has sold to one R. M. BAKER of Collin County the real Estate belonging to the said decedent Estate consisting of a tract of land of 66 & 2/3 acres of land as heretofore reported in the inventory filed in said Estate and he reported to the court that he has sold said land for the sum of nine Hundred dollars being $13.50 Dollars per acre and the payments as follows four Hundred dollars cash and four Hundred dollars in twelve months time he would represent to the court that this the highest prince said land can be sold for that it is a fair and good price for the same wherefore he prays that said sale be confirmed by the court and that he be ordered to make title to the purchaser upon said BAKER complying with the term of sale.

TEAL survey in Denton County and 5 acres of land out of the KENNEDY survey in Collin Co. & that all of said land is timbered land and he prays that a final hearing of this account the same be approved by the court and that he be finally discharged as administrator of said Estate having fully administered the same.
