…the following persons are heirs of said Estate to wit A. L. FAIRES a daughter of his intestate, ANNIE McCORKLE, VIRGINIA McCORKLE, BETTIE and FANNIE McCORKLE all grand children of his intestate. LOUISA A. REYNOLDS a daughter of his intestate. D. M. BELL also a daughter of his intestate. He would state that he has paid to A. L. FARRIS $82.82 to LOUISA A. REYNOLDS (?) $116.60 to ANNIE McCORKLE $1.25 that these amounts were for articles bought by the above parties at the sale of property belonging to said Estate that this reporter now has their notes for the above amts. and that he himself bought at the sale property to the amount of nineteen & 05/100 Dollars that all the debts or nearly all have been paid off, that there is no (?) necessity for collecting the above amounts & he asks that on a final settlement of said Estate each one of the above parties may be charged with the amounts received (?) by them that all the parties so having received property are (?) heirs at law of his intestate & that the amts. each have received would not Exceed their share of said Estate. He would show that he furnished to D. M. BELL one Hundred dollars about the 23rd day of November 1878 and that she is also one of the heirs of said Estate and he asks that this amount be charged to her in the settlement of the Estate. He would show that the amount furnished to MRS. D. M. BELL was in money out of the $390.00 reported herein as money on hand and if the amount $100 is to be charged to MRS. BELL in the distribution of the Estate then your reporter has only $290.00 money belonging to said Estate in his hands. …for the past year 50 bushels of wheat & 400 bushels of oats that he still has this property on hand. And now in conclusion your reporter would say that the reason why he has not presented this report sooner was because he thought he could in one exhibit show the condition of the Estate so that it could be partitioned and distributed among the heirs of said Estate but that he has now found this course to be impracticable wherefore he asks that he be excused for not sooner having filed a report of the condition of said Estate that this account be received and confirmed by the court and that the notice required by law be given of the filing of this Exhibit and for such other relief as to the court may seem proper.

In the name of God, amen. I SAMUEL D. ANDERSON being sound in mind by weak in body do make this my last will and testament revoking all others heretofore made do ordain and dispose of all my real and personal property as follows viz.

 

1st that all my lawful debts be paid.

 

2nd. I will and bequeath to my nephew WILLIAM P. ANDERSON son of WILLIAM D. ANDERSON dec’d. One Hundred and fifty-nine 70/00 acres of land situated in Linn County state of Kansas.

 

3rd. I will and bequeath also to said                 WILLIAM P. ANDERSON one twenty Dollar gold piece and my watch as Keep sakes.

 

4th. I will and bequeath to my niece SARAH ELIZABETH ANDERSON one twenty Dollar Gold piece as a Keep sake.

 

5th. I will and bequeath to my nephew W. P. ANDERSON and my niece SARAH E. ANDERSON all my remaining money and effects after all indebtedness is paid to be divided between the said nephew and niece as follows two thirds to my nephew and one third to my niece.

 

6th. I will and bequeath that my remains be placed in a metallic coffin and taken to the state of Kansas in Gerrand County and be deposited in the Grave yard by the side of my mother in charge of my Executor.

 

7th. I hereby leave and appoint as my Executor DAVID ADAMS of Collin County Texas to settle my affairs both in Texas and in the state of Kansas and state of Kentucky.

 

8th. I will and bequeath to my nephew W. P. ANDERSON one c___  Silver half dollar that has been an heir loom for may [many?] years and…

STIMSON files this his 1st report of the condition of the Estate of his said wards’ and says that on the 11th day of March A. D. 1879 he received the sum of two hundred dollars by Express from C. O. SAXON administrator of the Estate of M. SAXON said M. SAXON being the grandfather of your reporter’s said wards and said money being part of said wards’ interest in their said grandfather’s Estate which is now being administrated in Graves Co., Kentucky and your report would show to the court that on the 12th day of May 1879 he received from the same source for his said wards the sum of sixty Eight Dollars making in all the sum of $268.00, which he has reserved as guardian of said wards and he states to the court that the above amount is all the money or property of any Kind that has come into his hands up to this date which belongs to his said wards’ Estate. He would show to the court that on the date of the receipt of the above mentioned $200.00 he paid express charged on the same to the above of $2.25 as will appear from the voucher marked 1 and he has also paid to J. M. BENGE $15.20 as per voucher no. 2 and to J. L. STIMSON the sum of $46.50 as per voucher no. 3, Your reporter is allowed the sum of $13.00 being 5 percent coms. [commission] on the $268.00 received by him and also 5 percent on $63.95 paid out $3.19 paid J. L. DOGGETT 4.00 for drafting this report as per voucher no. 4.

The bay mare numbered above 4 was sold and the proceeds invested in farming implements for our accountant’s ward. The blazed face mare numbered above 5 was disposed of for a mule and con (?) which is now being used by your accountant’s ward. The Gray mare no. 6 was sold for $25.00 proceeds invented in clothing & provisions for said ward. The sorrel mare no. 7 died with distemper. The brown horse star in forehead & no. 10 died with leg broke. The Gray mare, no. 12 has been sold & used in improving ward’s farm, the colt is dead. The Iron gray horse colt no. 13 has been traded for bois d’arc post to improve land of ward. Your accountant states that the above is all of the personal property that has come into his possession belonging to his said ward and that there is no money in hand or other property belonging to said ward except that mentioned…

…above and that he is now ready to turn said above mentioned stock & property over to his said ward on the hearing hereof that his said ward will be 21 years old on the 30th day of this April and is capable of taking care of his Effects he would further show to the court that there has been a partition of the 148 acre tract of land belonging to SAMUEL SULLIVAN Estate in the District Court of Collin County and that his ward received (blank) acres of said land as his portion and that his ward is now in the possession of the same. And your accountant states that the (unreadable) land as reported in the inventory is his ward’s estate is now in the possession of his said ward he would also show to the court that he has paid to WHITE & DOGGETT attorneys the sum of thirty Dollars $30.00 attorneys fee in partition suit above mentioned in the District Court of Collin County receipt herewith filed marked Exhibit 7 and that he has paid the District Chokes (court’s?) costs in the partition suit to the amount of $36.94 which said receipt is herewith filed marked Exhibit 2 and your accountant would state that his ward is indebted to him in the sum of One Hundred dollars for money paid out and expended for him and his Estate and he would show to the court that his ward has Executed his promissory note for said amount dated the 21st of June A. The State of Texas              The last will and testament of MASTIN C. ROBINSON. Know all men that I MARTIN C.

County of Collin                   ROBINSON of above county and state being mindful of the uncertainly of human life and being of lawful age and sound mind do make and constitute this my last will.

 

First. It is my wish that all my Just debts be paid.

 

Second. I give and bequeath to my wife MARTHA A. ROBINSON all the household and Kitchen furniture together with the place or house stead containing one hundred acres of land purchased of U. H. HADLESS it is part of the JOSEPH BRUGES (?) survey assignee of Wm. Rogers.

 

Thirdly. I give and bequeath to my children viz. MARY J., LACY E., HENRIETTA J. E., SAMUEL J., WILLIAM J., MARTHA J. and MASTIN M. ROBINSON and to any other that may be born to me one hundred acres of land apart of the S. M. RAINER survey and purchased by me of JOSEPH BLEDSOE. Also fifty acres of timbered land on Pilot Grove creek purchased of B. M. CARR it being a part of a tract of land pattended (sic) to B. M. CARR as assignee of WILLIAM H. MOORE to be equally divided amongst them when the youngest shall come of lawful age or dispose of as herein after provided.

 

Fifthly.

                I give and bequeath to my wife and children as community property all the perishable property of which I am possessed also the crop of the present year after my debts are paid.

Sixthly.  I do make constitute and appoint my wife MARTHA A. ROBINSON my true and lawful Executrix hereby investing her with full power to carry out the premises of this my will as fully in every way as I might or could do if I was present and acting for myself and I do appoint her the lawful guardian of my children fully authorizing her to manage and control any and all of the effects left to them in the way she may think most to their interest also to sell the lands left to them and proceeds to layout the money received for it in lands elsewhere for the benefit of the children fully (without any orders from court authority her to make titles to the same or/any post thereof and for anything that she may do either as executrix or guardian of the children, this is her sufficient authority any expenses or trouble making application for orders from court except the proving & recording this will and further it is my will that she does not be required to give bond or security for the faith full performance of her action during her grdonhood (guardianhood?) but if she shall contract a second marriage then it is my wish that she give bond and security and make annual returns to the proper court.

 

Seventhly and lastly commenting the case of myself and family to a faithful creator I assign and seal these present in presence of J. L. BROCKMAN, W. L. BELLEU and N. T. WHITE of Collin Co., Texas and on this the seventh day of August A. D. 1869 Eighteen Hundred and sixty nine.

In the matter of the Estate of M. C. ROBINSON dec. March term 1879.

                This day in open court personally appeared before me the undersigned authority N. T. WHITE to me well known who after being by me first duly sworn deposes and say that he and W. R. BELLEU, JAS. L. BROCKMAN signed the instrument of writing dated the 7th day of Aug. 1869 and filed in this court 17th day of March 1879 by J. M. Benge clerk which purports to be the last will and testament of MASTIN C. ROBINSON dec. as attesting witnesses thereto at the request of the said MASTIN C. ROBINSON dec. that the said MASTIN C. ROBINSON signed the instrument in the presence of affiant and the aforesaid W. L. BELLEU & JAS. L. BROCKMAN affiant further says that the said MASTIN C. ROBINSON dec. was at the time of the signing the instrument of writing of the said over the age of twenty one years and was of sound mind as affiant believes and affiant further says that he and the said W. L. BELLEU & JAS. L. BROCKMAN were each over the age of fourteen years when they signed said instrument of writing as witness.
