Your petitioner W. D. BERRY after obtaining leave of the Court to amend his original application offers this by way of amendment & answer to petition of GEORGE HUGLEY [sic] for the guardianship of the persons & estates of JAMES GATES, SARAH GATES, JULIA GATES, BOB GATES minors would say that before your petitioner made application for the guardianship of said minors the said GEORGE HUGLEY had neglected and refused to make application and had stated that he would not apply nor have any thing to do with the matter all of which was known to your petitioner. That by this refusal & declaration of the said HUGLEY your petitioner was induced to make said application & your petitioner says that by the acts & declarations of the said HUGLEY he is estapped (?) from setting up his claim to the guardianship of the said minors wherefore your petitioner prays that the application of the said HUGLEY be refused & that your petitioner be appointed in his stead as prayed for in his first original application and in case the Court should decide that sd. HUGLEY was entitled to the appointment as prayed for in his petition then & in that event your petitioner prays that the sd. HUGLEY be adjudged to pay all costs incurred by this petitioner & for general relief.

PAGE for the sum of $20.00 which has not yet been allowed by this administrator as will appear from the list of claims herewith filed marked Exhibit X and prayed to be made a part of this petition. Your applicant states that he has only on hand the sum of $52.15 to meet the indebtedness of his said decedent’s estate and that there is no other personal property belonging to his decedent’s estate that is of any value to amount to any thing (sic) and that it is necessary to sell the following described real estate belonging to his decedent’s estate to pay off the debts of said estate and which is described as follows to wit: a lot about ½ of a mile north of the Public square of the city of McKinney in Collin County State of Texas on Kentucky street in said city and on the East side of said Kentucky street Beginning at the n. w. Corner of a lot sold by JOHN H. NIX to Mrs. STRGODILL Thence north 16t feet to a 1 acre lot of land conveyed by JAMES McKINNEY and wife to the H. & T. C. Ry. Co. Thence East 100 feet. Thence South 165 feet Thence west 100 feet to the place of beginning. He states to the Court that the above described real estate is all the property of any kind belonging to his decedent’s estate except a small pile of old lumber which is almost worthless. He further states that the probable task of administration in this estate will amount to the sum of forty or fifty dollars wherefore he asks on the hearing hereof that your Honorable Court enter an order allowing said administrator to sell said land for the purpose of raising (?) money to pay said debts.

The State of Texas to all persons interested in the administration of the Estate of JOHN NIX decd. J. L. DOGGETT administrator has filed in the County Court of Collin County an application to sell certain real estate belonging to the estate of said JOHN NIX decd. which will be heard at the next term of said Court commencing on the 3rd Monday in May 1880 at the Court House thereof in the city of McKinney at which time all persons interested in said estate may appear and contest said application if they see proper. Herein fail not under penalty of the law and of this writ make due return.

Minors estate of ERASMUS D. BACCUS and GODFREY S. BACCUS and represents to the Court that he gave bond as guardian of the estates of said E. D. & G. S. BACCUS August 12th 1873 and took charge of said estate at that time. The inventory of said estate filed at that time shows that the estate consisted of Real Estate valued at 1247.50 and personal property 575.00 575.00 1822.50 Total

$1822.50 none of the real estate was then in cultivation except about 14 acres. It is now all fenced & about 80 acres in cultivation. The personal property consisting mostly of stock has been taken care of and increased much in value. The boys have been sent to school & all their expenses paid and their property turned over in full to them. Their just receipt for the same is hereby presented to the Court. He states to the court that he has collected since his last annual account which was filed Sept. the 18th A. D. 1878 the sum of ($936.66) nine hundred and thirty six dollars and 66 cents the proceeds of (illegible) of 66 2/3 acres of land which he sold to R. M. BAKER under a former order of this Court and that said sum of $936.66 is all the money that is in his hands belonging to his decedent’s estate. He would state that on Tuesday the 4th day of May 1880 he proceeded to sell at public outcry to the highest bidder one half Cash & the remainder on six months from date of sale at the Court House door in the town of McKinney Texas the following described property to wit 200 acres out of the D. CRUTCHFIELD survey for a more particular description thereof reference is made to the order of Court authorizing the sale of said lands to the following parties to wit 40 acres near the South East corner of said 200 (illegible) to ROBERT FOSTER for one hundred dollars, 40 acres on East boundary line of said 200 acres to Wm CARTER for $93.50, 10 acres on South west corner of said 200 acres to JOHN B. HOWARD for Sixty two & 50/100 dollars, 110 acres on west boundary line of D. M. CRUTCHFIELD survey & a part of said 200 acres to ISAAC GRIFFIN for five hundred & seventy seven & 50/1000 dollars, 97 acres out of JOSEPH CRUTCHFIELD survey in the north East Corner thereof to ISAAC GRIFFIN for $612.50 reporter would state that the reason he sold the land in different lost or parcels was because he thought the same would bring more in that way & he further states that he believes that the land has been sold for as much as it will bring at any future sale. STIMSON the father of the wards for their board while they were going to school & your reporter submits to your honor whether the said claim is a valid & just claim against the estate of his wards. He would also state that said sum of $77.98 deducted from $182.96 leaves the sum of $104.98 money belonging to said wards now in your reporter’s hands and he would state that it may amount to more than this sum as the interest accumulating on said money has not been calculated in his report. Premises considered he asks that the notice required by law be given of the filing of this report & for such other & further relief as to the Court may seem fit.

.Missouri on or about the (blank) day of (blank) A. D. 1877 and that he has no will duly probated in this state as required by law and that said decedent departed this life as your applicant is informed and believes intestate that he has no executor or administrator in this state and no heirs in this state & that he has no property real or personal in this state except a claim in this county against one GEORGE WHITE for the sum of Two tons (two thousand?) and dollars [sic] and for the collection of said claim a suit is now pending in the District Court of Collin County and that said suit cannot proceed to judgment against said WHITE for the want of a representative (administrator) to represent said AFFLICK deceased in this state and that it is necessary that administration be granted on said AFFLICK’s estate that said case may proceed to judgment. Your applicant further shows to the Court that said AFFICK was at the death of his death and still is justly indebted to Throckmorton Hamn (?) & Bro. in the sum of One hundred dollars and to Hare and Bedsoe of Grayson County in the sum of $100.00 and to McClellan & Doggett of this Collin County Texas in the sum of one hundred and fifty dollars and that all of the above mentioned creditors are resident citizens of the State of Texas and that there is no other property or effects out of which said claims can be paid except out of the proceeds of the said suit against said WHITE as aforesaid. Wherefore your applicant prays on the hearing hereof that letters of administration be granted to him on said estate.
