County of Collin                   Be it remembered that there was begun and holden a term of the County Court on this 16th day of May A. D. 1881 it being the third Monday in May, for the transaction of the Civil and probate business present and presiding the Hon. T. C. Goodner County Judge where the following proceedings were had:

                                                Now on this day come on to be hear the application of V. H. ALLEN admx. of said Est. to sell certain hereafter described lands for the payment of the debts of said Est., and it appearing to the Court that it is to the interest of said Est. sell said lands at private sale, on a credit of six months. The Admx. is hereby authorized & Empowered  to sell said land on such credit, taking mortgage on said land and personal security for the payment  of the purchase money as required by law, reporting said sale &c. at the next term of this Court. Said lands are described as follows, 1st tract Situated in Collin County about 5 miles N. from McKinney being part of a 640 acre survey made in the name of ANDREW THOMAS and part of two tracts, one of 141 acres deeded to T. J. ALLEN and 162 acres deeded to M. W. ALLEN by MARTHA ALLEN, beginning at the N. W. corner of said 141 acre tract a stake in the W line of the THOMAS survey, it being 19 50/100 chs S of its N. W. Corner Thence E. 12 28/100 chs. to the N. W. Corner of a 40 acre tract allowed to MRS. V. H. ALLEN by the Court Thence S. 3816/100 chs. its S.W. corner. Then W.12 28/100 chs. to a corner in w. line of the THOMAS Survey thence N. 38 16/100 chs. to the place of beginning containing in all 46 ¾ acres of land.

…part of a 79 acre tract sold to M. W. ALLEN by MARTHA ALLEN. Beginning at the S. W. Corner of said 79 acre tract, a stake from which an Elm (?) 8 in. in dia. mkd. ┼ bears N 1° E. 290 lks. Thence N.13 60/100 chs. its N. W. Cor. at stake from which a Spanish oak mkd.┼ bears E. 43 chs. Thence 19 80/100 chs. a stake. Thence S. 13 60/100 chs. to S. line of the afore said 79 acre tract. Thence W. 19 80/100 chs. to the beginning, containing 26 ¾ acres.

Admr. of said Estate to sell the following described tracts of land to pay the debts of said Estate. 1st tract, part of the JOHN COFFMAN survey in Collin County, beginning at the N. E. Corner of a tract conveyed by L. P. ALREAD & wife to H. ct. (?) BROWN, & C. BLACK, Thence S. with the East line of said tract to the N. E. corner of Eleven acres taken off the S. end of said tract, Thence W. parallel with the S. line of said COFFMAN survey until it comes opposite a large view (?) of water N. of op (?) house on BROWN’S eleven acres. Said line is to Curve N. so as to include one half of well, leaving sufficient room to pass to the well, Thence with the N. line of said Eleven acres, to its N. E. corner on the East line of the CHENOWETH Survey, Thence E to the place of beginning, containing 69 acres.

4th tract of 20 acres part of JNO. COFFMAN survey in Collin County Texas, beginning at the N. W. cor. of said tract a post in the J. M. KINCAID S. (?) line. Thence S 88° E with said line 24 chs. 22 lks. to the N. E. cor. of said survey a post, thence S 2° W 8 chs. 20 lks. thence North 88° W 24 chs. 22 lks. to the W. line of said survey Thence 2° E 8 chs 26 lks. to the beginning. And it appearing to the Court that it to the interest of the Estate to sell said lands at private sale for cash; the admr. GEO.COFFMAN is hereby authorized and Empowered to sell at private sale for Cash reporting the sale to this Court.

                                                                Your petitioner J. R. BUTLER  a resident citizen of Collin county Texas would respectfully represent & show That he is the father & natural guardian of MARTHA STELLA BUTLER aged 4 ¾ years & SARAH VASTE BULTER aged 2 years minors & females residing with him in Collin County.

                That the said minors by inheritance from their mother who is deceased are heirs to the Sum of about  five hundred dollars in their own right each being Entitled to receive the one half of said sum. That said sum of money is at present in the hands of TASWELL LEATHEW the legally appointed guardian of the Estate of said minors & resident at present in Haroldson Co. in the State of Georgia. That said guardian is prepared to hand over the amount so held by him on behalf half of said minors to your petitioner who prays that he may be appointed Guardian of the Estate of said minors of Collin County with authority to receive their said property as soon as it may be transmitted to him from Georgia.                                                     Clementson & Church

Your reporter would show that the bay mare valued at $40.00 and the 2 year old valued at $20.00 as appears from the inventory, have both died. He would further show that their intestate died (?) leaving the following persons as his heirs at law to wit: MRS. ELIZABETH COOPER, his surviving wife, and AURILLA RIGGS, now wife of W. L. RILY, WESLY H. RIGGS, S. A. RIGGS, now wife of T. B. PATTERSON, & W. L. RIGGS all the children of said decedent & his surviving  [wife] MRS. COOPER. They would show that all the property returned on inventory was the community property of GEO. RIGGS decd. and his wife now MRS. COOPER that they have paid over to each one of the heirs the following amounts as advancements & in full satisfaction of their interest in said estate to wit: to MRS. L. A. PATTERSON $85.00, to WESLEY RIGGS $67.00 that the total amts. pd. to all of said heirs would amount to the sum of #307.00, that this sum added to $259.90 would make $566.90, that MRS. COOPER is entitled to one half of this sum to wit: to $241.77 that each one of the above named heirs are entitled to one fourth of said $241.72 which would be $60.43 to each one. They would also state that gave said heirs part money in some instances and money at other times and that they have paid each the amounts as herein before stated as will fully appear by reference to the receipts of the said heirs which are herewith filed.

They further state that all the debts against the Estate have been paid off, that there is no property now in their hands belonging to said except a few household articles which are worthless. They would also state that the following heirs live in Clay County Texas, MRS. L. A. PATTERSON, wife of T. B….

PATTERSON, MRS. AURILLA RILEY, wife of W. L. RILEY and WESLEY RIGGS & that W. L. RIGGS lives in Schauyler County State of Illinois. They would also state that the property as appears on the inventory except the house & lot sold as before settled and the two animals alleged to have died was given to the heirs as will appear, from the receipts of said heirs, and they ask that said assets paid over to said heirs be charged against them in the distribution of the property & that the remainder of the Estate now in reporters hands be given to MRS. COOPER, that when MRS. COOPER shall have rec’d. this amt. she will not have recd. her full share of the Estate Premises considered reporters pray that the notice required by law be given of the filing of this application that on final hearing these reporters be discharged from their trust and that this administration be closed and for general Equitable and special relief.

W. EDWARDS the surviving parent of said  minor has given his consent in writing to such apprenticeship, it is therefore ordered adjudged and decreed that said application be granted that said application be granted that said BERRIGAN shall be entitled to the Custody of said minor…

                                                Now on this day comes PETER BERRIGAN and files with the Court a bond for one thousand dollars payable to WILLIE EDWARDS a minors of the age of 2 yrs. 9 mos. & 15 days signed by J. C. ENGLAND &. H. H. FINLY [FINLEY] as sureties and conditioned as the law requires for bonds apprenticing minors, and the Court being fully advised of the matters & things therein  contained and being of the opinion that said bond in all respects complies with the law. It is therefore ordered & decreed by the Court that said bond be in all things approved and that the same be recorded by the Clerk of this Court and it is further ordered adjudged & decreed by the Court that he said PETER BERRIGAN be & he is hereby authorized to take charge & control of the person of said WILLIE EDWARDS & retain the same until she the said minor arrives at the age of eighteen years or until she marries if she the said minor marries before that age.

Collin County                       Know all men by these present the we PETER BERRIGAN (blank) as principal and J. C. ENGLAND and H. H. FINLEY as sureties are held and firmly found unto WILLIE EDWARDS a minor in the full and just sum of One thousand dollars for the payment of which well & truly to be made we bind ourselves our heirs & legal representatives jointly & severally firmly by these present.

     The condition of this obligation is such that whereas the above bounded PETER BERRIGAN has this day by an Order of the County Court of Collin County Texas had the above mentioned minor apprenticed to him. Now if the said BERRIGAN shall furnish said minor sufficient food and clothing; shall treat said minor  humanly; shall teach or cause to be taught said minor the occupation of being a housekeeper; shall furnish said minor medicine & medical attention when necessary; that he will if practicable send said minor to school at least three months in each year during the continuance of such apprenticeship after said minor has arrived at the age of ten years and which said minor is within the scholastic age; that he will not remove said minor out of the County without the leave of the Court; and that he will not remove said minor out of this State then this bond to be null & void otherwise to remain in full force & effect.

                                F. M. MARSHALL Guardian of the estate of JOHN BACCUS a minor would respectfully show that your petitioner on the 18th day of April A. C. 1881 in the City of McKinney sold certain real estate hereinafter described (belonging to his ward JOHN BACCUS) to W. C. & J. HARRIS said real estate consisting of 32 acres of land at Eleven Dollars per acre total $352.00. One half to be paid Cash in hand and the other half to be paid on or before the 1st day of January A. D. 1882 bearing 12% interest per annum from date of note until paid said real estate or tract of land is described as follows.

                                Situated in Colin County Texas on Rowlett’s Creek being a part of a survey of 640 acres made in the name of JACOB BACCUS abst. No. 53. Beginning at the Center of said Survey a post from which a hackberry bears South 87° W 25 lks. Thence South 16°poles to a post in the South line of said survey. Thence West 160 poles to a post the South West corner of said survey. Thence North 160 poles to post  in the west line of said survey. Thence East 160 posts to the place of Beginning containing 160 acres of land.

                This land is the same that was deeded by JACOB BACCUS SR. to JACOB BACCUS JR. recorded in Book N, page 468 Collin County records the said ward is entitled to 1/5 interest in the above described land which is 32 acres sold by virtue of an order of the Probate Court dated 21st day of March A. D. 1881 at a private sale a full and correct account whereof is respectfully submitted to the consideration of the Court.

                                                                                And now on this day came on to be heard the complaint of M. D. JONES, formerly BALDWIN joined by her husband A. L. JONES against J. A. PEBBLES & L. W. GROCE, and it appearing to the Court that R. C. WOOD guardian of the said M. D. JONES was bound by the County Court of said County at the March Term A. D. 1881 on the 28th day of March on the final settlement of his Guardianship to be indebted to her in the sum of nineteen hundred & twenty dollars which sum said WOOD guardian as aforesaid was ordered to pay over to the said W. D. JONES by said Court. And it further appearing to the Court that said WOOD failed and refused to pay over said sum of money or any part thereof in obedience to said order when thereto requested. And it further appearing that the said R. C. WOOD was duly appointed Guardian of the Estate of the said W. D. JONES then BALDWIN who has since intermarried with the said A. L. JONES on the 10th day of Sept. A. D. 1879 and that as Guardian the said R. C. WOOD as principal and J. A. PEBBLES & L. W. GROCE as sureties on the 17th day of Sept. A. D. 1877 entered into bond as is required by law, for the faithful discharge of the trust of said WOOD in the sum of five thousand dollars which bond was approved by the County Judge of said County on the 24th day of Sept. A. D. 1877. And it further appearing to the Court that the said M. D. JONES joined by her husband A. L. JONES made complaint in writing to the County Court of said County that the said R. C. WOOD has failed and refused to pay over the said sum of nineteen hundred & twenty dollars as ordered by said Court, which Complaint was filed in said Court on the 31st day of March A. D. 1881 and Citation was duly issued to said J. A. PEBBLES & L. W. GROCE sureties as aforesaid who were alleged in said complain to reside in Grimes County…

Commanding then & each of them to be and appear at the present term of the Court to show cause why Judgment should not be rendered against them for the payment of said sum of money which Citation was returned by the Sherriff of Grimes County duly served on the 4th day of April A. D. 1881. And it further appearing that said J. A. PEBBLES & L. W. GROCES this day appeared open Court by their Atty. A. J. HARVEY and neither said WOOD nor said sureties have showed any cause for the nonpayment of said sum of money heretofore adjudged against said R. C. WOOD Guardian as aforesaid. It is therefore considered adjudged and decreed by the Court that the said M. D. JONES & her husband A. L. JONES do have and recover of and from the said R. C. WOOD and the said J. A. PEBBLES & L. W. GROCE sureties of the Guardian bond of the said R. C. WOOD the said sum of nineteen hundred & twenty dollars with eight per cent Int. from the 28th day of Mrch. A. D. 1881 together with all costs in this behalf expended for which let execution issue.

…who is a resident citizen of Collin County Texas who is a resident citizen of Collin County, Texas would represent to the Court that                 WILLIAM BRADLEY who is a boy about 16 yrs. of age and a resident of Collin County Texas has no guardian of his said estate. That both of the parents of Wm. BRADLEY are now dead. That  said WILLIAM BRADLEY is over the age of 14 years and owns an Estate of the value of five hundred dollars situated in Collin County Texas and being real property to wit: 18 acres of land in the N. W. Corner of the EDWARD BRADLEY survey about one mile from McKinney the same being in cultivation, and 6 4/10 acres of land in a survey made in the name of SAMUEL McFARLAND about 2 miles from McKinney being on Wilson’s Creek and being timber land he would represent that said Wm. BRADLEY is a son of JAMES BRADLEY and CARLOTTA BRADLEY both deceased and that both of them were citizens of Collin County and that each died in Collin County and that the entire estate of said Wm. BRADLEY is situated in Collin County Texas. He would further represent that heretofore to wit on the (blank) 187_ one T. T. BRADLEY was appointed guardian of the estate of said orphan by the probate Court of Collin County Texas and officiated and acted as such guardian until the day of his death. That said BRADLEY departed this life on to with the day (sic) of February 1881 and that letters of guardianship has not been issued to anyone on the Estate of the aforesaid orphan since the death of said T. T. BRADLEY wherefore he prays that legal notice be given of this application upon the final hearing of the same that he be appointed guardian of the estate of said Wm. BRADLEY.

It is ordered adjudged and decreed that said final report and account be in all things approved and it further appearing that there is still remaining in the hands of the said H. H.                                                                                                 THOMAS SPIVEY citizen of Dallas County respectfully represents that heretofore to wit: Jany. 21 1879 that he as surviving heir of EMILY SPIVEY dec. filed in the County Court of said Collin County an inventory and appraisement of the community Estate of himself and the said EMILY SPIVEY to which reference is hereby made for a description thereof; that at the instance and request of W. S. TURNER one of the creditors of said Estate he presents the following as his exhibit to the Court in writing and under oath, showing fully and specifically what is required of him by law.

 

The following debts against said Estate were presented to him and have been paid off by him, one note given to J. M. SALMONS & transferred to LUCY H. SPIVEY principal & interest amounting to $845.00

 

W. S. TURNER has recovered a judgment in the District Court of Collin County, for the sum of One thousand and fifty six Dollars & foreclosing the vendors, been (?) upon 56 acres of land apart of the land rendered upon the said inventory and the same has been advertised to be sold on the 1st Tuesday in April A. D. 1881.

…note due for part of the purchase money due upon the real Estate rendered as community property on said inventory: 50 acres of land to LUCY H. SPIVEY in payment of the before mentioned note which was a lien of said land; 33 acres to R. T. SPIVEY which had been sold to him before the death of said EMILY SPIVEY and he had paid for the same.

That the four horses on said inventory have died.

That the 5 head of cattle have all died except two which were sold & proceeds used by the family.

That the Corn, Cotton, port and wheat was partly used in the support of the family and that the balance was sold and the proceeds arising therefrom (sic) were used in the support and maintenance of the family.

That the farming utensils, Household & Kitchen furniture and wagon remain on hand and are used by members of the family. That there remains on hand 69 acres of land in the MARY SCOTT Survey in Collin Couny Texas, which he avers was erroneously rendered by him as community property on said inventory; he avers that the money used in the purchase of the same was his separate property and that therefore the said 69 acres of land as aforesaid is his own individual property and not community property of himself and his deceased wife, EMILY SPIVEY.

That the following named persons are the surviving children of him and his deceased wife, EMILY SPIVEY to wit:

WILSON guardian of the Estates of JOHN, JAMES, GEORGE, LAURA, MARTHA & JANE WATTS minors of the condition of the Homestead that at a previous term of this Court was set aside to MRS. RACHEL WATTS surviving wife of GEO. WATTS deceased and the aforesaid minors and the matters and things contained in the report; and it appearing to the Court that MRS. RACHEL WATTS and ELLEN BRADSHAW wife of JAMES BRADSHAW were present in Court represented by their attorney and that ELLEN BRADSHAW is the daughter of MRS. RACHEL WATTS and her deceased husband GEORGE WATTS and that at a previous term of this Court the following described property set aside for MRS. RACHEL WATTS for the use and benefit of herself for the use and benefit of the aforesaid minor children viz: the North half of lot No. 27 in Block No. 4 in the City of McKinney as laid out in the original plat of said town and Known as the Butcher pen beginning at a point in the south line of a tract of 23 acres sold by Wm. DAVIS to DAVID STIFF from which the South West Corner thereof brs. West 7 chs. 85 lks. thence South 12 chs. 15 lks. a post thence East 7 chs. 48 lks. post thence North 2 chs. a post thence 7 chs. 43 lks. a post in the middle of of the track of the Houston and Texas Central Rail Road; thence therewith North 1/2 ° East 240 lks North 2 ½ ° E 152 lks. I JOSEPH E. DULANEY, being of sound mind and disposing memory, do make and publish this my last will and testament, revoking all others which I may have previously made.

 

First

I nominate and appoint my wife LUCY A. DULANEY Executrix to carry out the provisions of this my last will. She may however associate with her in the execution of this trust any one whom she may see proper to select having business experience and a concern in the welfare of my family.

 

Second

It is my will and desire that all my just debts be paid and that all my unsettled business in Sullivan County be settled up and adjusted as soon as practicable after my decease.

 

Third

It is my desire and will that all my interests in realty in Sullivan county be sold by my Executrix. It is my desire that my interest in the widow’s dower in the old W. R. DULANEY place, together with the lots in the town of Blountville on which I now reside which are encumbered in part for the support of the widow and for purchase money, shall be so arranged with DR. N. T. DULANEY that he will take same assuring the obligations thereon, standing in my shoes in reference to same and paying to my Executrix the fair value of my original share as an heir and for improvements made by me on said premises. I trust that this arrangement may be effected without difficulty. If it prove impracticable or inexpedient,  then it is my will that said interests be disposed of by my Executrix, on the best terms possible. I desire that my interest in a lot in the town of Bristol which I hold in common with DRS. N. T. DULANEY and M. M. BUTLER be likewise disposed of giving the other part owners the privilege taking said interest they paying for same what may be considered reasonable. The funds derived form these sales together with that from my personal effects shall become assets in my Executrix’s funds for the payment of my debts and to be used in the support of my wife and children…

I will and devise all my lands lying in the State of Texas, being an improved lot in the town of McKinney Collin County and a farm in said County; a tract of timbered land on Elm Fork of Trinity River in Denton County near Lewisville; a tract of about 110 acres Wise County some six miles South of Decatur; a tract of about 265 acres in young County and another tract containing some 320 acres in Stephens County to my wife LUCY A. DULANEY for and during her natural life, with remainder in fee simple to my three children CORRIENNE, ANNA MARY and JOSEPH FIELD, but if it shall become necessary for the support of my family or for the Education of the children, or for the improvement of any particular tract or lot of the lands My Executrix is authorized to  sell any part of said lands, reserving however that in Collin County for home and support, unless necessity should require its sale also. But as to sales, and the order in which the several tracts or parcels may be disposed of, a large discretion is given my Executrix.

 

Fifth

 

I will and bequeath to my brother WILLIAM A. DULANEY all my interest in the books &c. of the estate of W. R. DULANEY Decd., also all my medical journals my pocket case of instruments except the scissors and such of my medical works as my wife may be willing to dispose of or such as she may not be particularly desirous of retaining in the family.

 

Sixth

 

I will & bequeath my gold watch to my wife LUCY to be kept & used by her. If my son JOSEPH FIELD should arrive at an age when he would so need a watch I trust she will then give it to him.

HUFF for $6.25 he has been unable to collect & the same is insolvant. Your reporter would further represent that he has charged himself with $625.00 of W. D. BERRY note when he is entitled to a credit of $140.00 on the note on HALEYS & BRINSON for $126.60 there should be a credit of $50.00 & another of fifty five 33/100 dollars as per the affidavit of W. T. & T. J. HALEY; on the note for $150.00 on E. B. HUDSON and J. E. ENGLAND, there should be a credit for $45.00 on the note of $150.00 on S. COFFEY & H. E. RIXRODE there should be a credit for $19.00 on the note of S. B. MARSALIS, JOHN SEXTON & T. MARSALIS for $90,00, there should be a credit for $46.80. All of which he prays maybe taken into account & that he be allowed the proper Credits therefor (sic) on this settlement.

Your reporter would further represent that the named persons are heirs at law of said J. M. GATES all of who reside in Collin Co. to wit. LELA VINCENT, GRIM___(JENNIE?) ENGLAND, JAMES GATES, LILE GATES, JULIA GATES, ROBERT GATES; last four are minors represented by their Guardian G. D. HUEY and JOHN GATES a minor and LUELLA KILLGORE late widow of said GATES & Guardian of said minor. And your reporter would further state that in obedience to an order of the Court he has turned over the household & Kitchen furniture and farming implements, and one wagon to said heirs. The previous Considered Your petitioner prays that he account be allowed and that upon paying over the funds in his hands to the persons adjudged to receive it that he be discharged from his trust.

                                MR. HODGES a citizen of Collin County Texas represents that J. W. HODGES is a minor over the age of fourteen years, that said minor is now living within the limits of Collin County Texas and that all of his property is situated in Collin County Texas, that the estate of said minor is of the probable value of one thousand dollars & that it consists in the main of real estate. He further shows that both the mother and father of said minor are dead, & this applicant is the brother of said minor. Premises considered applicant asks that the notice required by law be given of the filing of the application that he be appointed guardian both of the person & estate of said minor & for general & special relief.

EFFIE and JESSE WHEELER minors                            Now on this day comes on to be heard the Report of sale of land by WALTER WHEELER Guardian of the persons and Estates of EFFIE and JESSE WHEELER minors and the Court having inquired into the manner in which said sale was made and being satisfied that the same was fairly made and in conformity with law; it is ordered adjudged and decreed by the Court that said sale be in all things confirmed and the Report ordered to be recorded and the proper conveyance of the property so sold to be made by the Guardian to the purchaser J. H. BOWMAN upon his compliance with the terms of said sale.

Now comes WALTER WHEELER Guardian of bother the persons and estates of EFFIE WHEELER and JESSIE WHEELER minors and in obedience to an order of said Court made at the present term on the 16th day of May 1881 most respectfully reports that on the 16th day of May 1881, he sold for cash in Collin Co. to J. H. BOWMAN at private sale for $1905.00 the following described tract ordered to be sold to wit: An undivided one half (1/2) interest in and to 160 acres of land in Collin County situated on the waters of Rowlett’s Creek 12 miles West of South from McKinney, being the west half of the B. J. MATTHEWS sur. of 320. Beginning at the S. W. corner thereof and at the N. W. corner of the SANFORD BECK survey of 640 acres. Thence East with the south line of the said MATTHEWS survey 39 chs. and 68 lks. a post from which a persimmon marked X brs. W. 65…

And said Guardian further reports that the other tract of land ordered to be sold and described as follows to wit: In Collin Co. part of a survey patented to ANDREW PENARO and beginning at the S. E. corner of a tract sold to C. T. MANN Thence North 50 chs. to said MANN’S N. E. Corner. Thence East 300 chs. to post from which an elm 8 in. in diameter marked X brs. North 2 East 14 lks Thence South 50 chs. to point in Rowlett’s Creek Thence West up the Creek 3 chs. to the place of beginning; And the personal property set forth in the said Guardian’s report accompanying his application for the sale of said lands heretofore filed, have not been sold and that the said J. H. BOWMAN is now ready and willing to comply with the terms of said Sale.
