                                                   November Term 1881

 

 

…was a single man and left no wife nor children surviving him. He would represent that his wife is a sister of deceased and as such that petitioner will be and is ___noted (?) with the administration of said estate, his wife being an (sic) heir at law of the deceased, he would further represent that he is over the age of twenty one years and is entitled to administration said estate. He would represent that deceased was indebted to several persons at the time of his death and that his estate is still in debt in the sum of five hundred dollars or more. He would further represent that several persons as petitioner is informed (?) and believed are indebted to said estate. He would further represent that the deceased was the owner and proprietor of a retailer grocery in McKinney at the time of his death and left on hand a stock of liquors, wines, cigars &c. and that Just before his death he had taken out a license to retail the same which are still in full force and that said stock of liquors will have to be retailed out as petitioner believes that he would further represent that deceased left no surviving wife and that there is no relation of deceased in Collin County nor an agent of any such of nearer kin than petitioner’s wife. He would represent that on the 10th day of September 1881 Judge T. C. Goodner County Judge of Collin County Texas granted him temporary administration on said estate. Wherefore he prays that legal notice be given him or and on the final hearing that he be appoint administrator of said estate and after such appointment for an order of Court allowing him to retail out said stock of liquors, cigars &c and for such other orders as this case may require.

And it appearing to the Court that notice of such application had been given as required by law; And said will together with the testimony of JNO. R. ROGERS one of the subscribing witnesses thereto being heard and examined by the Court and said testimony reduced to writing, signed, sworn to and filed, it is ordered adjudged and decreed that by the Court that said will be admitted to probate and established as the last will and testament of J. H. FOSTER decd. and the terms stipulations therein be in all things confirmed. And it appearing to the Court that by the terms of said will NANCY FOSTER is named as executrix will full power to administer said estate without the intervention of the probate court, and exempted from giving bond, it is ordered that letters testamentary issue to the said NANCY FOSTER and that she have full power to administer said estate without the further intervention of this or any other probate Court, other than the filing of an Inventory of said estate in this Court.

1st It is my desire that my remains after my decease be interred decently & in accordance with my finances.

2nd It is my desire that all my Just debts be paid.

3rd After paying my funeral expenses & all my Just debts I give & bequeath to my beloved sister NANCY FOSTER all my property real & mixed together with all money notes & accounts due me.

4th I hereby nominate constitute and appoint my said sister NANCY FOSTER the sole executrix of this my last will & testament and direct that no action be had or taken in the courts of the County relative to my estate except the probate of this my last will & testament & the return of an Inventory & that my said Executrix be not required to give any bond.

NEWSOME are entitled to one eighth interest of the personal property of ALLEN NEWSOME deceased. That the said two last named minors are residents of Collin County. That the minors ARTHUR C. & ROBERT E. NEWSOME are each entitled to one half of one eighth interest in the personal property of the said ALLEN NEWSOME decd. as the only surviving children of C. C. MELTON Gdn. of the estate of SAMPSON FINLAY a minor, of the following described land the property of the estate of said minor to wit: Situated in Collin County Texas about 10 miles S. W. from McKinney and being a part of a 160 acre tract of land in the name of SAMPSON FINLAY SR. Beginning at N. W. corner of a 160 acre tract patented to SAMPSON FINLAY and being his headright. Thence South 475 varas a post. Thence East 950 varas a post. Thence North 475 varas the N.E. corner of said survey. Thence West 95 varas to the place of beginning being one ninth interest in 80 acres of land.

   And it appearing to the Court that said sale was made to Wm. BUSH for a fair price and in conformity with the order of this Court the same is approved and said Guardian directed to make title to said purchaser upon his complying with the terms of said sale. And that said report be recorded.

MELTON Guardian of the estate and person of SAMPPON FINLEY a minor would beg leave to make this his report of the sale of the following described tract or parcel of land to wit: Situated in Collin County State of Texas about 10 miles S. W. of McKinney and being a part of the 160 acre tract of land in the name of SAMPSON FINLEY SR. Beginning at N. W. corner of a 160 acre tract patented to SAMPON FINLEY and being his headright. Thence South 475 vara a post. Thence East 950 varas a post. Thence North 475 varas the N. E. corner the N. E. corner of said survey. Thence West 950 varas to the place of beginning being one ninth interest in 80 acres of land. He states to the Court that he sold said above described land in pursuance of an order entered and made by your honorable Court on the 21st day of November A. D. 1881 to one W. M. BUSH on this the 22nd day of November A. D. 1881 in Collin County State of Texas for cash and for the sum of eight dollars per acre making for the eight and eight ninth acres of land the sum of seventy two ($72.00) Dollars. Said land was sold to said BUSH at private sale and that said BUSH will comply with the terms of said sale upon a deed being made to him for said land.

…for authority to cancel a sale of lands made by D. W. SHAW Decd. during his lifetime to J. W. & A. W. NORRIS. And it appearing to the Court that during his lifetime D. W. SHAW sold and conveyed to J. W. & A. W. NORRIS about 100 acres of land situated part, about sixty acres, in the T. M. RAINER survey in Collin Co. and part about forty acres in the M. J. GEMINEZ survey same Co. for the purchase money of which the said J. W. & A. W. NORRIS are wholly insolvent and unable to pay off said notes as they fall due. And it being made known to the Court that the said J. W. & A. W. NORRIS propose to cancel said sale and reconvey said land upon the surrender to them of their said notes. And it appearing to the Court that it is for the best interest of said estate that such action be had it is ordered adjudged that the said E. G. SHAW as admr. as aforesaid surrender to the said J. W. & A. W. NORRIS their five notes before mentioned upon their executing to him as such Administrator a good and valid conveyance of said land which land shall thereupon become a part of the assets of said Estate of D. W. SHAW deceased.

…Court which said estate would have to pay. That in addition to the additional cost of a suit in the Dist. Court the estate would lose the use of the proceeds of said land or interest accumulating on said notes. Admr. would represent that the said J. W. & A. W. NORRIS have proposed to him to cancel the trade made with decedent and re-convey said land to the estate upon the surrender of said five notes.

            Admr. would represent that it would be greatly to the interest of said estate if such action were had. And if such can be accomplished immediately the estate will have the benefit of the rent of such land for the ensuing year. Wherefore he prays that the Court grant him an order authorizing him to surrender said notes to the said A. W. & J. W. NORRIS and accept therefor[e] a re-conveyance or release of said lands to said estate.

CAMERON has paid said EMERSON & CO. $515.00/xx and that F. EMERSON & CO. hold a lien upon all of said real estate to secure the payment of the balance of said note.

A MELTON a citizen of Collin County State of Texas and guardian of the person and estate of SAMPSON FINLAY JR. a minor would beg leave to show to the court that his ward the said SAMPSON FINLAY JR. is about 17 years old, that he is desirous of obtaining an education, that he has little of no education and that he has no personal property except a small amount of money in all amounting to about $50.00 and that it will cost about $100.00 per annum to pay the tuition and for books and clothing and other necessary expenses to enable said war to go to school and complete his education.

            That said ward is the owner of an undivided one ninth interest in the following described tract of land to wit: Situated in Collin County State of Texas about 10 miles S. W. from McKinney and being a part of the 160 acre tract of land in the name of SAMPSON FINLAY SR. Beginning at the N. W. corner of a 160 acre tract of land patented to SAMPSON FINLAY and being his headright. Thence South 475 varas a post Thence E. 950 varas a post. Thence North 475 varas the N. E. corner of said survey. Thence West 950 varas to the place of Beginning, Containing 80 acres of land. L. D. & E. MAYFIELD Decd.             Now on this day came on to be heard the petition of J. M. COPE administrator of the Estate of L. D. & E. MAYFIELD Decd. to sell the perishable property of his intestates and the Court being fully advised in the premises, and it appearing to the satisfaction of the Court that all the corn belonging to the Estate is liable to waste from the deprecations of rats, mice & cattle are wild & are liable to stray off and be stolen & that it is too expensive to keep them up and feed them. It is therefore ordered adjudged & decreed that the petition of the administrator to sell said property be granted because the same is of a perishable nature. It is further then ordered that he give due & lawful notice of the time, terms and place of sale and that sale be made at public auction to the highest bidder on a credit of six months from the date of sale, purchasers giving note with two or more approved securities and paying interest at the rate of ten percent on the amount of purchase from date until paid.

That said Cotton weighed 1065 lbs. and that he received 6 1/2 per pound for the same making the amount received for same $69.22 1/2 . That said cotton was of last year crop and inferior cotton & that he believes the said sale was fairly made & for a good price –That there is still remaining on hand a small amount of lint Cotton of last year’s crop which he has been unable to dispose of as the same is not suitable to pack with good cotton. That the same is worthless wherefore he prays that the same be stricken from the inventory—wherefore he prays that this report be approved…

JONES Decd. to have a lien in his favor declared on certain moneys in the hands of the administrator of said Estate in person as well as by his attorney and also P. B. MUSE and announced themselves ready for trial, and this cause was submitted to the Court. And the Court after hearing the petition of Peff. and the evidence introduced by both parties and hearing the argument of counsel thereon and being fully advised of the matters and things therein ordered and adjudges that said petition be sustained and the prayer therein granted. It is therefore ordered adjudged and decreed by the Court that Peff. T. O. BOWER’s claim of Three Hundred and Fifteen Dollars be and the same is herby established as a lien on so much of the money in the Administrator’s hands arising from the sale of the saloon, bar, bar fixtures &c sold by him as T___ (Temporary?) JOSHUA MAYFIELD et al minors

                                                Now on this day came on to be heard the application of J. M. COPE for the appointment of W. E. COPE as guardian of the persons and Estates of JOSHUA MAYFIELD, JAMES MAYFIELD and ROBERT MAYFIELD minors—and it appearing to the Court that notice of the filing of said application had been given as required by law and no protest being made--and W. E. COPE having refused to accept said trust and J. W. COPE there upon coming in to open Court express (sic) his willingness to accept the same—It is therefore ordered adjudged and decreed by the Court that the Said J. M. COPE be and he is here by appointed guardian of the said minors. It is further ordered that letters of guardianship issue to him upon his entering into bond in the sum of Two thousand Dollars Conditioned as the law requires.

                                    The petition of J. M. COPE a citizen of Collin County Texas, shows that L. C. MAYFIELD and EASTER MAYFIELD his wife died in Collin County Texas in February 1881 and at the time of their death they both resided in Collin County, Texas—That at the time of their death they left an Estate consisting of a homestead worth about $1500.00 and some personal property. They also left three minor children all boys to wit: JOSHUA MAYFIELD aged 14 years or upwards JAMES MAYFIELD aged 12 years…

…or upwards  and ROBERT MAYFIELD aged 6 years old or upwards—said minors have no guardian legal or testamentary of either person or estate—That their relatives have shown no disposition to make application for letters of Guardianship of either the person or Estate of the said minors afore said. That there is an immediate necessity that the Court should appoint some suitable person to act as guardian of both the person & Estates of the aforesaid Minors. Petitioner would further state that WILLIAM E. COPE is a suitable person to act as such Guardian and that he is not disqualified in any Respect and besides is a resident of the County and state afore said. The premises Considered petitioner respectfully asks the Court that the minors afore said be cited to appear at the next term of this Court and that on final hearing of this petition the Court appoint W. E. COPE as Guardian of both the persons and Estates of the afore said Minors unless the oldest minor JOSHUA MAYFIELD should select some other person. And in the event the Court should not appoint W. E. COPE as guardian petitioner requests that some suitable person be appointed at the earliest date possible as such guardian.

Corner of said 305 acre tract. Thence E. 43 chains & 70 lks. a stack in at (?) N. W. cor. of a tract of 112 acres Conveyed Oct. 1st 1874 by said R. B. BUMPASS Decd. to LEM C. SMITH. D. 1881 within legal hours at the Court House in the city of McKinney in said county and State he exposed for sale the entire real estate of the said Decedent as described in inventory at present on file & the same was purchased by JOHN R. SMITH for the sum of Two thousand one hundred & seventy five dollars. That an order for said sale was made [and] was obtained from this Court on the 20th day of November A. D. 1881.
